Speaking as a nationally known credit score and mortgage lending expert (book, radio shows, newspaper columns)...

You should follow your lawyer's lead. Likely he or she will want to place the debt on the BK Schedule F, List of Creditors. That way, should a collection company try to collect, the debt will already be discharged in court.

I advise you compare the Schedule F the lawyer prepares with all unsecured debt you know you have, including any collection company who ever called, and also against a tri-merged (triple) credit report. I have found that lawyers make omissions which later come back to haunt my credit consultation or mortgage loan clients.

When you file bankuptcy, it includes all your debts.

A charged off credit card doesn't mean you don't owe the debt. It's an accounting term meaning the credit card company cleared it off their books. It's undoubtedly been sold to a collection agency.

You should contact a bankruptcy lawyer to determine if you can file. The rules have changed and it's not something you can do yourself.

Not only can you, you must. You obtain bankruptcy relief as to all debts which are dischargeable. Some debts, like recent taxes, student loans or domestic support obligations are not dischargeable. But all debts must be listed in your schedules
