You Joining Has no barring on him (you husband). The only problem you would have is during Basic and advanced individual training you have to give legal guardianship to some one if you husband is not out by that time. You should know that you are responsible for you dependant’s actions after you join. What that means is if you husband commits a crime on post or attempt to hide on post to avoid prosecution you could be charged under the Uniform Code of military justice. This could be from a ART 15 which is non-judicial punishment (meaning you get punished by your unit and could loose part of you pay for a period of time and have to stay after work and work until about 11:00 pm at night for a period of time) to a court marshal which you could do time also. In either case you could be separated from service. Also as long as you were not involved in or been arrested for any crime. As far as you husband goes it is possible for him to join with a waiver if he has not committed a felony involving drugs, Assault, and some property crimes. As long as he has no outstanding sentence or probation and has finished all restitution. He is not eligible if he has been convicted of domestic violence. He would have to talk to a recruiter and the truth has to be told. See you local recruter.

Yes you can join the military. and if your son is old enough so can he. If your son is under age then you will have to designate someone who would be responsible for him if youwent overseas and while at training where families are not allowed to stay with you. The acts of your husband should have any consequences for either of you in the military.

I would Wait until your husband got out of jail in order to enlist. I believe that any recruiter would tell you the same thing since at this moment they would consider you to be a single parent even though you are married but he in locked up.
When you join the military you have something called family care plans. you have to be able to have someone take care of a child with in 24 hour of receiving orders. However being that you are just enlisting and you are a single parent, like I said i don't think any recruiter would enlist you at this moment until he gets out of jail.

You and your son can join. Your husband cannot....Secondly, you may want to first ask a recruiter on each of your eligibility status and what MOS you desire...
I would suggest going into the field you would most likely use if and when you decide to retire from the military...At the present time the military is paying a lot for reenlistment bonuses. (50K and up)

If you are under age 42 (have not yet reached your 42nd birthday), you can join the Army. If you're under 35 (I believe), you can join the Marines. Check in with the respective service recruiters to get the exact age limitations. The incarceration of your spouse will not impact yours or your son's ability to join the military, provide neither of you have criminal records.

you yes him no..like the other posters said, the other thing you may want to take into consideration however is that if you were to go overseas depending on rather hes in jail for a felony or not he may not be able to get a passport....and since you have a child you would get a long tour accompanied, so thats 3-4 years that you would be away from your husband.

if you have a child, you cannot enlist unless you have a rock solid family care plan, since the military will assume your spouse will be the care giver. In fact, they MAY consider you a single parent, which DQs you from enlisting altogether.

for him it depends on what he is in jail for.
as for you your should be able to as long as you have a family care plan (someone to care for your child while your deployed) and again it depends on what hes in jail for.
if its anything involving armed robbery, sex offender, murder stuff like that i would say no but something like b-n-e he can still join but he could only go in as a ground pounder.nothing that requires a clearance as for you like i said you can still join
