No, the 40 hours before you have to be paid overtime is 40 hours when you actually worked, and does not include hours you were paid for but didn't work (sick, vacation, paid lunches, FMLA)

Oops, just noticed that your question is under UK. If that's correct and UK also has a law called FMLA, then excuse please - my answer is for the USA.

My understanding is that FMLA does not calculate into "hours worked" for the purpose of overtime calculation.
