Hi! My parents recently turned in their 2003 tax return. They received a refund check from the IRS. Now, like a month and a half later, they receive a notice of examination and want a bunch of information. Is this some type of glitch or can they come back after issuing a refund and decide to audit you? Thanks.

Of course they can. You do realise that this is 2007, right? Are you sure it is their 2003 return they are auditing?

Yes, they can audit you anytime up to 3 years after the date of filing. The refund check is merely the first part of the paper trail before the return goes into the 'hopper' to determine if it will be pulled for audit or not.

Tell your parents to answer only the questions asked, not to bring any extra paperwork so the IRS can't go on a 'fishing' expedition. As long as they have documentation for the deduction, there is nothing to worry about.

Yes they can. They have 3 years, but if they suspect fraud, there is no time limit.
Refunds are generally processed right away, but the return may be reviewed for action later on.
Do you mean 2003 or 2007? If 2003, no w3onder there's an audit. If 200o7, it could be a random selection,

Most audits are called for after the refund check is issued. The checks are issued almost immediately, but it takes awhile for the return to be run through the basic checks to see if an audit is suggested.

As far as the documents you will, need to first prove that your head of house hold, in which you must be in order to claim EIC. after that you must proceed on to the qualifying person test, in your case that is your niece and nephew. along with that you need supporting documents that those children actually lived with you for at least 6 months, and some of these documents can be school, medical, or daycare service records. that have the same address as you. also fir the qualifying person test, you must include the birth certificates, for each child, in which it would have their mothers name on it that and they would be able to link you two together as siblings. then you have to show proof that you paid for the up keeping of the home IE: like rent, utility bills, cable phone ETC. They only thing is that your sister was claiming the kids to get welfare, and then your claiming them on your refund. if all goes well and your able to send them all necessary information , then you will be fine and they will release your refund to you. make sure that when you receive the notice in the mail you respond promptly with no delay.. Yes. The rule is that taxes must be assessed within three years of the filing of the return (with few exceptions), not the due date for the return.

It is normal for a refund to be issued before the return is examined.

YES. THE IRS CAN GO BACK AS FAR AS THEY LIKE. AND WHENEVER THEY WANT. I'VE SEEN IT HAPPEN! MAKE SURE YOUR PARENTS GIVE THEM AS DETAILED AND AS MUCH INFORMATION AS POSSIBLE. MY SAYING IS THAT IF YOU CAN'T PROVE IT YOU'LL PAY FOR IT! YEAH THAT'S THE IRS FOR YEAH!
