I'm not familiar with that case, but I know that it is definitely illegal to shoot at someone who is fleeing and has their back to you.
If I were on the jury, you would go to prison for that... even if you were firing into thin air... I've lost friends to gun violence and do not tolerate "vigilante justice" at all.

A. Never, you never ever shoot warning shots at a shoplifter unless they pose a deadly threat with a firearm or other instrument. Even then you dont shoot a warning shot, you shoot to stop.
There are three principles a law enforcement officer must obide by when firing.
1. Target aquisition-Get the target in your visual sights.
2. Target identification-Make sure you are going to fire at what you first intended to fire at. Identify your target.
3. Target isolation-Make sure that when you do fire, you isolate the target. Look for dangers that might lie beyond the primary target or around it.

There is an exception to one of these requirements, it is called the isolation exception. This exception allows an officer to fire without isolation if the danger of not shooting is greater than the outcome of what would happen if the officer did not fire. Ex: A crowded mall, someone has a gun and is firing willingly and randomly. You may shoot that suspect without isolation because he needs to be stopped immediately.

A. Try to get a good description of them to give to the police. Don't shoot at them. If you hit someone else, It's you're butt in trouble, not the shop lifter's. A warning shot could hit someone, even if you fire into the air, it could still fall onto someone. The bullet has to land some where. Don't go after them. They may stop and fight. If you aren't a better fighter than them, they may beat the crap out of you. A simple rule is things can always get worse than they are. Let the cops handle it.

Shooting a petty criminal in the back is for cowards. NEVER, is there a good enough reason for you to discharge a firearm into the air amongst that large a crowd. Last week a cop in Oklahoma fired two shots. 1 killed a snake that was in a tree the other killed a 5 yr. old boy who was 100 yds. away fishing. There is no excuse for someone who was taught about firearm safety to take this course of action. EVER!!!!!

Never. Firing a gun in populated areas is very dangerous thing to do. A missed shot could seriously injure or kill another person. Most shoplifters are unarmed and do not pose a threat. The police are trained in how to use firearms so let them handle any situation in which lethal force is used.

this reminds me of a scene in a movie made in Brazil. Title Central Station. a man who stole a loaf of bread was pursued and shot dead bywhat appeared to be a security guard of some sort.thought at time of viewing that descision seemed harsh but I might have missed something. you choose none of them . If possible you call the person on it. they might return the stolen items.then tackle them or call the police if not one your self then catch and arrest them. the descisionto shoot is only used when the person is armed and dangerous

A...most shop lifters are small time crooks any how.....now if they were to rob a cash drawer of mucho moolah that might be different..or if a witness seen the perp carrying a weapon (even a shoplifter) then you might have just cause...plus there are probably many shoppers around...call for back-up while persuing....or if you dont like the perps looks ...shoot em....beam me up scottie

A. Never. Most shoplifting is a misdemeanor and I have slowly learned that most all of your stores won't prosecute anyway.
