I was somewhere recently and heard a few people talking about how one of their friends, a woman, married a total stranger who was an illegal alien. They said that the man was an illegal from the Middle East and the woman was paid to "marry" him. They met a couple of times before the "wedding" and have never seen each other since. They went on to say now their friend has fallen in love with a man who was born a US citizen and he wants to marry her. Only problem is that she's already frauduently "married" to this illegal and doesn't know how to get out of it. It got me to thinking what options would this woman have. I'm guessing the new guy knows nothing about the illegal marriage.

well, she could just tell a judge that her husband has abandonded her, since she has not seen him since. And legally can divorce him on this basis, the law will ask that she put an ad in the paper stating that she is looking for him. If he has been married 2 years or more, there is a good chance that he will not lose his papers. I disagree with marrying for papers. But if she made that decision her other option would be to not marry the new guy, just live with him.

It seems it's almost become the new arranged marraige. Sad to think something so sacred and special is also for sale.

In answer to your question.....the "marraige" the fraudlent one...has to stay for a period of time if they want to protect the original agreement. Otherwise.....as far as I know....she can divorce the person on any given amount of reasons. This is where this "globalization" of citizenship and marraige and child custody and all the rest is going to get really ugly in the future....they (the governments) put the cart before the horse when they thought this out...

You never said if she was legal or not. If neither are legal.....heck....now you're talking laws in foreign countries and everything.....

Any divorce attorney can tell her how to get out of the marriage whether she knows where he's at or not. Since he's not there to serve with the divorce papers the usual procedure is to publish a notice in the news paper in the city in which the guy was last known to live.

Nothing she can do but wait out the illegal marriage. I would hate to think the illegal were capable of if she was to get a divorce at this point. She made her bed and now she must lie in it.

Sounds like a fraudulent marriage -- false pretenses.

Her options are to admit her fraudulent marriage, and get it annulled on those grounds, or to try and lie about it and seek a divorce on other grounds.

either she can file for a divorce and give the money back or she fesses up to the new guy. i can't understand why people do things like this. that can land her in prison.

If she didn't consummate (sleep with him) then it is no consider a valid marriage and she can have it annulled.
