Okay, I am not sure where the bible states that human life begins at a certain stage, but I do know that God requires eye for an eye and tooth for tooth and life for life. (Leviticus 24:17-20). God shows us that He values an unborn child and considers it to be a living being at Exodus 21:22-25 (pay special attention to verse 23). Because if an unborn child was killed (even by accident) death was the penalty for the one causing the accident. This shows me that God views the life of a fetus as so precious that he requires life for life in the death of one.

According to
Exodus 21:22 If men strive, and hurt a woman with child, so that her fruit depart from her, and yet no mischief follow: he shall be surely punished, according as the woman's husband will lay upon him; and he shall pay as the judges determine.
Causing the death of an unborn fetus (at any stage) is made a civil matter only, with compensation given to the father. It is a specific exemption to the Eye For An Eye rules that surround it.
Therefore, according to the authors of Exodus, a fetus is not considered a human life (with the rights and protections pertaining thereto) until birth.
One other exception is made, just above this one. If you beat your slave to death, but it takes him or her at least three days to die, you're off the hook.

Mr. o: The question was not about common sense, it was about biblical law.

It is only common sense that a fetus is a living person from start to finish vs the political fiction that a fetus is not human during a specific stage of development. A baby in the womb is the creation of a dad, mom and the Holy Spirit..

Psalm 127:3 -- Behold, children are a gift of the LORD; the fruit of the womb is a reward.
Deuteronomy 30:19 -- This day I call heaven and earth as witnesses against you that I have set before you life and death, blessings and curses. Now choose life, so that you and your children may live.

EDIT
For Diminati:
When the offending man was striking the woman, was he trying to kill the baby? For most of the 9 months of pregnancy he would have no sure sign that a baby was there, and even after that in the heat of a fight is hardly going to have the rational capability to take on such a distinction. And even if he did, chances are he wasn't aiming for the baby anyway. It's like shooting into the woods and accidentally hitting a hunter instead of a deer; no one calls that murder, it's an accident. An accident never earns the death penalty in the Bible.

Its not a history book so you will not find the beginning of man's sojourn in the earth there. The scriptures are allegorical events that are taking and take place inside of you.

Daniel above said it. God considers life human from even before conception.
Mary was with child, she was told by the angel. Not "with fetus", or "with embryo". With child.
