When you're injured in an auto accident, and taken to the hospital, blood is drawn for a Tox., and alcohol screen. These results are almost immediate. If there is any evidence to show impairment, the Officer now has probable cause to give you the Implied Consent Warnings, and request that blood be drawn for analysis. You can now be charged with Driving Under the Influence.
The hospital has to produce the findings when requested by the Officer.

A bac will be run as part of a tox screen- part of ER SOP-
if it becomes a police matter, the records can be made available.

Either the investigating officer will request the BAC results from the hospital, or the DA will subpoena the results prior to going to trial. Either way, they will get the results.
