accident was other parties fault her insurance triple a repaired my car but i think they should have totaled my toyota instead of fixing. The other car involved was a ford explorer who backed into me in a parking lot and smashed my right front and side bumper.

Unless you are driving an '85 Toyota, that's not enough damage to warrant totaling it. Nor is it the type of damage that when properly repaired will materially affect the value of the vehicle.

You can sue if you wish but it won't go anywhere. If you don't win it's entirely likely that you'll be stuck with the other party's attorney's bills on top of your own. The way that attorneys charge that's probably more than the cost to repair the damage was in the first place.

A claim can be reopened when information that wasn't known by you comes into play. As far as 2 of your medical bills being in collection, you can call the collection agencies and explain to them your bills are the result of a car accident to be paid by the insurance company. Tell them to send the bills back to the creditor. You get your copy of the bills and present them to the insurance company and ask them why they were not paid. If they are related to your accident, then the medical coverage on the insurance policy is supposed to take care of them.

If they did not total your car at the accident--they won't...If your car is fixed--move on..
