I'm 17, and the other night my friend threw a bonfire. My friend and I got there around 9- 9:30 and we saw that there was a ton of alcohol and people we didn't know playing beer pong. We knew there was going to be alcohol that night, but we didn't bring it. Everyone at the party was getting really drunk, so my friend and I left and went to another friend's house where we were going to stay the night around 10:30. The party got busted around 1:30 and five people got arrested. In their questioning, 3/5 of the people said I had brought the alcohol. The cops called me in for questioning and I said I didn't bring anything. Can they still charge me? Is this just hearsay? What might happen because of this?

The person who threw the party that night called me and told me that "we're going to tell the police it was you so you can get screwed" I was completely sober, didn't drink at the party.

You see how difficult it can be for the police to do an investigation & find out the truth.
They find alcohol at a party for minors, and no one wants to take responsibility, but maybe they can blame an innocent person.
People blame innocent people all the time.
They might blame someone who is unpopular.
They might blame some girl who refused to sleep with them.
The innocent person being blamed might have no idea why they got blamed.
For the police to make a case against someone, they usually need more than a bunch of witnesses, of which none are innocent.
I mean the people at the party who got drunk, they are not innocent witnesses. To convict someone, there is a need for witnesses who themselves are not obviously guilty of an equal or greater crime.
Hearsay is when someone says you said something.
Saying they saw you bring the alcohol is a statement of a witness, a false statement.

They'll just write you a citation for underaged drinking
Yes it is hearsay, but since they were at the scene, it can be admitted as evidence/testimony at a court of law
If what you say is true, nothing will happen or at most a citation for underaged drinking (which doesn't really matter)
Should the police question you then point out there is an obvious flaw in the police's logic...if only 3/5 people said you brought the beer, what did the other 2/5 people say? (If they said anything, it will be contradicting what the other 3 ppl said)
Obviously...unless 5/5 people said you brought the beer, you're not in trouble
So nothing will happen, you're perfectly alright.

In hindsight, you probably should have avoided the party altogether. From there, it is a matter of sticking to your story. There would be little evidence that you ahd brought the alcohol. You didn't have any, so you wouldn't have touved any of the bottles, cans, kegs or whatever. You also were not there at the time the party was busted, making it a bit tough to prove that you actually ahd been there in the first place. They can perhaps charge you, but it is more likely that the police are fishing for information. They are accusing you as a way to get you to tell who did bring the booze. If they had evidence, you would have been charged, not questioned.

First of all, I am glad you left the party with the alcohol. That was very responsible of you.
You'll have to wait to see if you are charged with anything.
A big thing in your defense is that you weren't there when the bust occured. Plus you would have your friends where you stayed the night to say you got there at 10:30 and weren't drunk.
It would be weird to bring alcohol to a party and leave early without drinking it.

It would be a LOT of work trying to enforce everyone's myspace page. Nearly impossible. Locally a parent can contact their childs school if this is an issue, I know someone who did because her daughter was drinking (underage) with friends and they posted it online. But yeah, it's stupid, and something should be done. Parents should pay more attention to what their kids are doing. :-/

Don't sweat it until the police decide what they are doing. It may blow over. Since you were called in for questioning, you might be smart to speak to your parents about what happened. You are a minor, and you shouldn't have been questioned without your parents knowing about it. If charges are brought against you, by all means get an attorney! You did nothing wrong.

Sounds to me like they can't take their punishment.Besides,if you brought the alcohol why didn't you stay at the party and get s*** faced with everyone else? Maybe you should point that out to the cops.

Well have ur friend pull for u, first thing.
i really don't think it's that intense of a thing that cops will get severely serious..tell them that u didn't even really know who the people were and that u were framed.
idk if they'll believe u..but they can't just charge or do anything to u based on what people say.

The simple and quick answer is no. But, your freinds really shouldn't be drinking underage, all sorts of problems can arise. The son of a freind of mine recently had a fit and almost died the morning after he'd had 3 cans of beer. The cause - alcohol. Be very very careful in future, young bodies and minds aren't ready for alcohol until adulthood.

Law requires proof. They cant charge you off of hear say, however if Everyone tells the same story then its unlikely they are lying and the judge can rule against you. Especially if you admit to going to the place anyways since there was alcohol present.
