If he has not gone active yet, meaning to boot camp, and he does not to go in he can get out simply by telling the recruiter he has changed his mind or by doing so at the Armed Forces center prior to him taking the oath of enlistment. If he is already in he would have had to have flunked out or not made some qualification for the school and if that is so he still has to complete his contract. The Marine Corps does not guarantee specific "jobs" as most or all of the other services do, they guarantee a field which includes various jobs and then he is put into one of those fields. A person who signs up for "Infantry" might be a basic rifleman, assault gunner, heavy weapons or another job with the field; an Aviation Logistics guarantee includes aviation operations and supply plus some other smaller fields. The answer is maybe and it depends on if he has already gone active, why he did not get what he was/thought he was promised and what exactly he was guaranteed. A point to remember is that no service guarantees a job-they guarantee a school, after school you might actually do a totally different job then you trained for. This is how it should be explained and in my experience is how it usually is-the needs of the service is firsts and after schooling which was promised the needs of the service might mean you are doing something else.

In the 90's it wasn't a big deal if you broke a Delayed Entry Program contract even though it really is legally binding. Nothing happened at all except for some additional paperwork your recruiters had to do.

But once you were on your way to training you couldn't just change your mind.

Like someone else pointed out - the USMC doesn't guarantee anyone a specific job in the first place... only a general field of possible jobs. If your friend signed a contract and swore-in based on that then he IS legally and ethically bound and they can legally enforce it. Whether they will or not is up to them.

All he has to do is tell his recruiter that he has changed his mind, Look they will give the speech that he can not get out but he only in the DEP program and until he swears in the second time right before he ships out to boot camp he is really not in he only has a tentative spot. There will be trouble for him people do this all the time. I know I was a Navy recruiter back in the early 90's and the Marines were famous for stealing Depers so the answer to your question is yes!

Has he signed his contract? If the job they promised him is in the contract, they have to give it to him. But if the crappy job is in the contract and he signed it, then that's on him. He can still get out of it, i *think*. He might have to go through a lot of paperwork, but I'm pretty sure he could do it.
If he hasn't even signed the contract or been sworn in, he can just tell them, "Nevermind!" and walk away.
