I am not involved and the house is in both our names can they come after it?

Yes. You can contest it, and say that you were unaware of his illicit activities. You might even get your half of the value for it when they sell it.

If the seizing agency can demonstrate that the house was bought with proceeds from narcotics trafficking, they can and will seize it.

Hi- YES to answer ur question- ABSOLUTELY- Do you have children? You didn't mention this- They can also be taken from ur home, as you will be charged as an assecory to this crime charges. ALSO, they can take ur vehicles, depending on how much is involved. NOW, let me ask you this: Are you unsafe in this home? Are you being beaten and abused? Why are you staying there if so? Why is he staying there? This happened to my Son's in-laws. It was HELL! My daughter-in-law's grandma had to bail his sorry azz out of jail- $3000.00 I might add- in order for him to come to the wedding! This is why I decided to answer ur question. Their children were grown, but, would have been tossed into foster care- ASAP if they had not had adult children. If you are afraid of ur husband, I realize it is hard to get out. There are Women's Shelters or you can call Crisis Intervention Services in your area. There are always 24 hour hotlines. You didn't really add anything else to ur question- Do you use also? If you have kids, all it takes is a hair folicle test for them to show positive use has been around them. I work with Moms every Thursday Night- used to be called "MOMS OFF METH"- as it is in epedimic proprotions in my neck of the world. They have been victim to their husband's/boyfriend's drug world, and have lost their kids. I go to Court for Mothers that do all the right things, and the last Case ended up as ALL PARENTAL RIGHTS WERE TAKEN- The Foster Parents are now adopting the children of the victimized mother. SO, to answer ur question- YES-ABSOLUTLELY- BE CAREFUL- GET OUT IF YOU HAVE TO - ESPECIALLY IF YOU HAVE KIDS- KEEP SAFE! TAKE CARE! I am sorry this is so long, BUT THIS IS SERIOUS STUFF HERE!

Your car is considered "evidence" therefore the state has every right to keep your car as long as they desire. Secondly, they probably were going to charge you with the drugs, but your lawyer probably worked out a deal to drop that charge. However, the rest of your charges probably carry some hefty penalties. You better hope your lawyer is great bc you are looking at doing some time! Hope it was worth it! Good luck!

if we are talking about your husband arrested on drug dealing charges then yes may be able to attached to your house if they can show the drug sell profits went into the house

if your husband was arrested for drug possession as a user you should be OK

You should speak to a lawyer.

A neighbor of mine was convicted of dealing or using. He went to jail and the house was foreclosed. He had a wife and two young children. I believe she was using also.
Just before foreclosure, she allowed the house to be stripped of everything of worth. He was a contractor and did a lot of work on the house. They even took out the windows. I called the cops and they told me to mind my own business.
Place was boarded up for two years.

Um, I believe they can. His name is on the home, they can. If there are kids and you are on the house, they probably wont. But if you have 2 cars, they most likely will come after his if he is convicted.

was drugs found in the house or on the property?
If so you very well may have cause to worry.
Other wise MOST LIKELY they will not pursue impounding the house.

If the house was being used in the commission of a crime.
Yes... if it's paid for and you own it outright.
No... if you have a mortgage.

Because its joint ownership, then your house can be seized.

But even if it wasn't, since you know about the drugs then you can get in trouble.

my husband was arrested yrs.ago before i knew him,in his home.no,they couldn't come after the house,why would they?
unless you or your husband put up the house to bail him out of jail and he skips out.
