Well let me give you the background. I was in a car accident right after new years 2007. Hit from behind by three cars while I was stopped at a red light. Two of the drivers were found at fault by the police, and by their own insurance adjusters. I went to doctors and therapists and the injuries to my shoulder and neck were healed. They have paid me my deductible to get my car out of the shop and said they were going to pay me a settlement. They have already settled with my sister(passenger). They were ready to settle with me but I got a laywer b/c of the games they were playing with me. Is there some law once my laywer sends in the paperwork to settle that says they have such and such days to settle? I thought they had 30 days leagally I may be wrong, does anyone know? Also what do you think they might settle for, so far my medical bills are 5,000, plus my rental and car repair which totals about 8,000. I just want this to be over!!!

Thanks, B

Settlement can take years. It will go on until both sides can agree on the settlement. Once the terms are agreed upon, the Settlement Agreement will be drafted, all parties will sign it, and payment will be made forthwith.

The two parties can take as long as they want to settle. Settlement is a voluntary process. If at any time either party decides not to settle, they can drop out of the negotiations, in which case the issue will be decided in court. Make sure you tell your lawyer what you are willing to settle for, since sometimes lawyers will agree to a deal that may not be adequate.

A lawyer will drag this out as long as possible -- sometimes for YEARS. They will dodge your calls, ignore your letters and won't see you when you go to their office. The vast majority of injury lawyers are nothing more than negoitators that NEVER go to trial (because there is a good chance they will lose) and will settle for peanuts over the original offer made by the insurer hours before court. Games?? You have only begun to see games -- lawyers are the kings of games and they play EVERYONE. The reality is that lawyers only look out for themselves -- you are nothing but a cockroach to them and wouldn't recognize you if you fell on them.

I really can't respond about the length of time it takes to settle an auto accident claim. I can tell you that my husband suffered an injury due to faulty manufacturing and it took four years before we finally settled out of court with the three companies involved in our product liability claim. I imagine the insurance companies involved with you will try to drag it out in hopes you will cave in and accept a lesser amount than you are entitled to. You say you have an attorney. He will get between 30 and 35 percent of whatever you collect, so you can be sure he will get you the best settlement he can. Just hang in there and let him do his work. After they settle, the insurance companies will have 90 to 120 days to pay you. They will probably use every one of them.

it oftentimes purely takes some weeks. as quickly as your lawyer gets the examine, she will deposit it right into a believe account and make contact with you to come back and %. up your component and sign the settlement and launch papers.

they will pay ALL your bills and then your laywer he or she then will then in turn after his cut pay you. You need to contact your laywer and find out where you are in the process.

You got a lawyer--he has to answer your questions--not us. he should be fighting for you--ask why he isn't.
