I was driving with my friend and the security company (wackenhut) wanted to pull us over, he had no lights so go figure. Obviously we didn't even know he wanted us to stop, so we didn't and at the entrance to the community (which is not gated because its public roads) another guy who was radioed ahead stood in the way of the exit flashing his flashlight signaling us to stop.

First of all if we stop can he hold us until the cops arive? What are his limitations to holding us if he is alowed.

I was just speeding and i was still in the car, can they guy either pull me out of the car to hold me, or can he just stand in the way?

Here's the question for you:

1. What was the reason of the stop?
2. Where you stopped within a private premise?

The only time the security could stop you if you have committed a crime and you are being held to be arrested. They can't hold you for any speeding violations/or any traffic infraction because a police officer has to observed the act before issuing a summons--DEFINITELY not through other people's observation.

However, if you were trespassing a private property...or they smelled alcohol in your breath while driving in their jurisdiction--then they can hold you and call the cops since it will become a safety issue...

otherwise they dont have the power to hold you.

Even a citizen arrest will have limitations. To the punkthat nabs drunks I would love to meet you. I like to tap the idiot pool. And fortunately for you there are so many to choose from. However you have been targeted for redemption,. If I don't see a post within 24 hrs. of my answer to you, you will go down. I use tactics worse than any PD, and you know your due for salvation of this sort. Most drtunks do not bother anyone. You can not get a speeding ticket from a police officer if a security guard saw you speeding. The officer would have to observe the traffic violation.

Security guards can and will detain you for the police if they observe a crime. (remember that petty misdemeanors such as traffic violations are NOT crimes, but ordinance violations).

yes they can, same as joe q citizen if they see you driving wreckless or doing anything else illegal.
granted stopping ifo a veh is stupid and dangerous.
it's a citizens arrest.
next time don't speed and risk having someone call you in at 911 as an agressive driver or follow you to your destination and wait for the police

oh yeah and i'm sure he radio'ed to his dispatch who called the police for the driver.

we get calls from dispacth like that alot

yeah that is legal as long as they have a reason....i manage an grocery store overnight and its legal for me to physicaly detain people that shoplift or are drunk...if they run they get tackled and wrestled to the ground..i always use the minimal amount of force possible...as long as they didnt shove u or punch u unprovoked it was all legal...of course i think these kind of laws vary state to state

if they hold you and you are not arrested you may have a case of false imprisonment against the company
