A coworker of mine had an auto accident on Monday. The other person hit her 3 week brand new car. A police officer showed up and supposably filled out an accident report. The coworker calls within 48 hours (like she was told to) and was told there was no accident report on file and the officer who was on the scene of the accident was on his last day of work before retirement. Neither people's insurance can do anything without a report, although the police aknowledge the fact that it happened? Who is responsible? What can be done about this? The police say they can't do anything and cannot get a hold of the now retired officer.

BTW her insurance company says there is nothing they can do until there is a police report. She has been going back and forth all week regarding this.

The (now) retired cop screwed you. Getting ahold of him will probably amount to nothing.
Your friend's insurance company is lying to him/her. Insurance companies can do whatever they want and they can certainly take a claim without a police report.
Have your friend go back to the police department and insist they file a report. They can do that even though it happened on Monday. I mean it was the department's fault it was never filed to begin with. If the desk officer tells your friend that they won't, have your friend talk to the sergeant or duty officer. Make sure your friend reminds them that they failed to do their job to begin with.

That's a crappy thing to have happen. I don't like insurance companies that do this. They have the owner of the car do all of the leg work.
Anyway it's BS what the insurance company is saying. They have accident reconstructionists that can recreate the accident.
Tell your friend to go to the police and file the report.

The PD is negligent in this and whether the retired officer filled out a report or not (sad commentary that he wasn't a better representative in this case), you can still fill out a report of your own, as can the other party. At that point it is up to your insurance companies to handle the rest, including trying to contact the retired officer. Hopefully you have a witness you can list to back up your claims.
Good luck and sorry this officer gave the department a black eye through his negligence.

The insurance companies do not need a police report to do their own investigation. Adjusters can get statements from drivers and witnesses, examine the damaged vehicles, and hire a reconstruction expert if necessary to resolve any dispute about how the accident happened.

It is the policeman's responsibility to make the report. It was his job to. Somebody should be able to help your coworker get the report made if not by him but by another officer. Have her to her lawyer to see what needs to be done legally but that could cost her money if they open a case up. Talk to the police captain as one suggested. Good Luck!

Your friend should get a lawyer. I have been in a few accidents and I have been screwed around by the insurance companies. With what happened with the screw up of the officer, I wouldn't hesitate to get a lawyer and have them get this taken care off - otherwise your friend could spend a lot of time trying to get things taken care of.

Have your friend to make contact with the other driver to get there license info. and the vehicle info.. If they can not reach the other driver and the P.D. who took the report still will not help? Contact the Highway Patrol. I'm very sure they will help and maybe the S.B.I. or IN.T.F. will complete an investigation on that P.D..

They can do something. Request a follow-up visit/inspection and report be issued by the police. They are responsible. Talk to the local police captain.

sorry to say but i think you are screwed, the police are worthless. i had 1,800.00 damage done to my vehicle and the guy admitted it to the state trooper, it went to9 the prosecutor and the prosecutor said "not enough evidence" they are all pricks, and the justice system sucks, we, the innocent people, always get screwed while they protect the criminals, they should all be shot and thats that. sorry for your bad luck, hope you can work it out. try calling the attorney general for your state and see if they can help you.
