The Japanese are tough!

The thing is if the wife gives birth in Japan and is Japanese the child can be Japanese (I think the child can be Japanese if the child is not born in Japan providing at least one parent has Japanese blood).

The child will not be American but is allowed dual nationality until the age of 21. From that age they have to choose or the Japanese will choose for him. I presume that the mother knows this as a result she wants the child born in Japan.

If the child is born in the USA it will be American regardless of it's parents immigration status.

What is the wife's citizenship, if she is Japanese, it would be Japanese. But then again the Japanese have very strict laws when it comes to foreigners, you need to check with the Japanese consular. Unless you or the wife or US citizens the child will not be a USA citizen. I think your wife should have the baby where she wants to.

If he would be a Citizen, He probably would have both, but he only holds a green card, the baby is going to be JAPANESE CITIZEN.
