Culture, yes. In order to be a religion, in the sense of being tax-free, you need some official organizational structure, and then it would not be all Goths, but those who joined the organization.
Still, I think it is legitimate to consider Goth a culture, because it seems to have considerable staying power, the way the hippie culture has survived. Music, common moral codes (not entirely in common on every detail, but definite trends), concepts of dress and language, of independence and also of community: all these create a culture which has survived, at least in certain enclaves, for some forty years. In fact, this is the 40th anniversary of the "Summer of Love," which is often considered the official beginning of the hippie culture. And if you doubt it has survived, I suggest you visit Santa Cruz County, California, and especially the Santa Cruz Mountains. There are other places as well, but that's one I know all about.
An interesting factor there is that hippies never claimed to have a unified religion, but a great many hippies were involved in the creation of the modern neo-pagan religions.

it already is a legit culture, and it cant be a legit religion because goths have all sorts of differant beliefs.
