Chances are the defense would be that he is too young to fully understand right and wrong. A murder at this age would be , at most, considered manslaughter. He would probably have to undergo therapy. I don't see him being locked up. There would probably be more penalties for his caretaker for neglect.

I'd say he'd have to get therapy. But if he did kill someone it would likely be accidental. I've seen stories where a child wanted to comfort his baby sibling and covered his face with a stuffed animal or pillow or whatever (fictional, but I suppose it could happen) so the baby accidentally suffocated. Same with anything else though. I can't picture a 5 year old being deliberately evil. I think that nothing would happen beyond therapy for the child, but I think something more might happen to you for failure to properly supervise your own child.

1. How could a 5-year old kill anyone? You are always around to MONITOR what he does, right?
2. If he killed someone, and you were the only other person in the house, most likely, you would be prosecuted for negligent homicide for not watching your child while he was killing people. Nothing would happen to your 5-year old....not even institutionalization.

I have a 12 Year old and wonder these things as well. I think the child would go to Juvenile Hall.

Excuse me? What is WRONG with you? If he did you need to tell the cops... You could go to jail for murder. DUH! And how can a 5 year old kill anyone? Sounds like you want to plan something and blame it on the kid since he probably won't get into trouble!
WELL... since you said that- I believe if a child commits murder... They would be institutionalized like others have said. SORRY for jumping to conclusions, but there are some WEIRD people on this sight!!! My apologies!

It depends on the State you live, but nevertheless it is a 5 year old and he will be judged as a juvenile.

do you know something about your son?? maybe you need to get him counseling before he grows up to be a killer, i am a mother also and i have never even thought of something like that about my child.
