Well the law states that a child should be a childsafety seat until they are 4ft 9in or 80pd (I think is the weight)..... due to the fact that the seat belts in the vehicles are not designed for tiny people. I am sure that is why her parents still have her in a "childsafety seat" is because they are determined to abide by the law no matter how crazy it may be.
I agree that this is a crazy law because they are some full grown adults in the world that still need a "childsafety seat" according to the law ....... I am only 4ft 9in and weigh 95pds (soaking weight and fully dressed) and well I am not going to state my age but I will say that I have 2 grandbabies and 3 full grown children. .... so I guess I should drive around seating in a "childsafety seat" YEAH RIGHT!!!!!!!!!!!!!!!!!!!!
As far as your sister's friend all she can do is abide by her parents rules ...... and hope she does not get picked up to bad for being in the 5th grade and riding in a "childsafety seat"

The average size for a 5th grader would be around 4 foot and 9 inches, so I think that she shouldn't be in a car seat.

im not sure about other countries, but here in New Zealand it is suggested that babies are in carseats until age 3-4 then go into booster seats until 10. Im not even sure how old a 5th grader is, but it sounds as though the carseat is more of a booster seat (without a back) and at the end of the day, if the child is not too heavy for the seat, they are doing the best thing by their child as it raises them up so the seatbelt is not across her neck.

Seatbelts are designed for average-height adults, not kids (or even very short adults). It's just physics. If the car is in a crash, a short person will slip out of the seatbelt and be thrown from the car, or, alternatively, might have the seatbelt injure them because it is in the wrong place on their body. If you want the seatbelt to work, a short person needs to be in a booster. It doesn't mean that the occupant of the booster is a baby -- just that they're short. Your sister's friend's parents are thinking that if their daughter is in an accident, they want her to have the best possible chance of survival. There are worse things a parent could do to a child.

The recommended weight for a child to still be in a car seat in Australia (though its not often followed) is 32kg (70.5pds) or age 10.
She is safer and more protected in her seat and her parents are doing the absolute right thing. My daughter is 5 and only just 20kg (45pds) so she will be in her car seat for a few years yet whether she likes it or not. I don't trust other drivers and if it saves her life one day, then its a good thing don't you think?

I'm sure it isn't a toddler seat... if the seat is height and weight appropriate for the 5th grader, then it is perfectly fine. Seatbelts in cars are designed for adult safety.

According to the law if she is under 5 feet tall she should be in a booster seat. I found out because my daughter is JUST 5 feet tall and is 21...I always tease her about getting her a booster seat for when she drives!

If you're talking about a baby seat, it doesn't make sense.
If you're talking about a booster seat... that is the law in a lot of states (they have to be over a certain weight or over 12 years old to ride in the car without them.)
My daughter is ten and I don't make her sit on her booster seat anymore (she's nearly as tall as me!) but I make her ride in the back even when it's just the two of us in the car because my car has air bags and if we wrecked it would probably break her neck or smother her.

Safety! Here in the UK children have to sit in car seats/boosters until they reach a certain height and in some cases thats when they are about age 11!
