I recive a ta free pension my soon to be e makes about 19000. she woul have recived 2800. she fieled a joint return and with my numbers she recived a7000 .00 return this was done with out my knolage. the money was direct deposited into her acc. my accountent who is a cpa and a very good firend was unaware i was not in the house he is very upsett. my atterney is trying to avoied court and get a chield support credit. she is not cooperating. can i report this to the irs i dont want to but my cpa firend in a bad spot but how can a bank accept a check in both names in to a account just in her name

If you succeed in convincing the IRS that the joint return that was filed was filed without your knowledge, the $4,200 will not go to you, it will go back to the IRS.

If you file a joint return, the Earned Income Credit and Child Tax Credit will go to the custodial parent for the benefit of the child. Since you have no taxable income, the child benefits by your filing a joint return and there are no negative consequences for you.

No court will issue you a "child support credit" based on a tax refund. The IRS does not pay your child support.

She would have had to forge your name on the return and on the check. That is against the law. Report her. Your CPA should give you the proper advice. That's what you pay him for. Call the IRS. They are not helpful and you will spend a lot of time on the phone and nothing they say to you can be held accountable to them. It must be in writing from the proper source. You might go visit a local office and talk to them about how to proceed. Better to look someone in the eye when you get advice. You should have already filed. Did you file an extention? You need to get on it.

Did you sign the tax return? The refund check should be in both names if she filed a joint return. She probably did it on-line and then you do not physically have to sign it, but you come up with a pin # and count that as signature and requested that it be directed deposited. So your lawyer has to bring that up in the divorce paperwork papers that you agree and sign, that the amt owed to you (x amt) is credited to child support or something. Make sure it is in specific writing. I don't know that the IRS needs to know, because what could they do? They may be able to agree that yes you should get half of it, but how do you prove that you got nothing and she got all. Get all the proof you can get, bank statement copies or printouts. Like that it went in her account and that your name wasn't on it. Then you could write them a letter, and then they can write her a letter that she owes them the amt then they could pay you, if will they do that. They don't seem to move very quick though. Is your divorce happening soon.

Your soon to be ex-wife has committed tax fraud by filing a joint return without your ok. Yes, you should definitely report it to the irs. The bank should not have done that with accepting the check in both names to an account in just her name. You may be also able then to go after the bank for doing that.

As to the deposit, the two signatures on the return authorized the deposit to be made to that account, so the IRS would have sent it to that bank account.

As to your signature on the return - well, that's a problem, since somebody had to sign your name to it. If it wasn't you, tell her that if you don't get your share of the refund, you are going to report this to the IRS - it's forgery, a crime, and they won't take real kindly to that. That might "encourage" her to give you the money.

Well, if she filed a joint return she must have forged your name, so right there is reason to sue her.
