I quit my job at a local bank in Texas. We got paid 2 weeks behind. so what I worked for the 1st-15th of one month I didnt get paid for that time until the last day of the month. I gave my two weeks notice on the 27th of June. I received my check stub for my pay on the 30th showing I was being paid for June 1st-15th. I then worked the remainder of my two weeks in July. Coming out to be 8 days. I then received a paycheck with my pay stub (my time card is ON the pay stub) my pay stub showed me what I worked June 16th-30th I was paid on July 13th. I figured since we were paid two weeks behind I would received a paycheck at the end of July for the 8 days I worked. I have no paycheck stub or check showing pay for those 8 days. but I called HR they denied me my check and argued that they pay current pay and that my check stubs had nothing to do with our pay. I'm also being denied vac time. Saying I only earned 46 hours but took 51 hours. but my ytd on my last check stub says I took 40 hours.

Report them to the IRS, US Dept of Labor, and your state's Department of Revenue. If your figures are correct and they are not willing to fix it, then they are breaking the law.

No they cannot deny you the hours that you worked! That is just not right at all. If you worked those hours then you are due a final paycheck for those hours.

Is there anyone else you can call--the payroll administrator or even someone at corporate that would be able to help you get the money they owe you? They can't just keep your money that you earned! You should also be able to get your vacation time (they call it Paid Time Off or PTO at my husband's work) that you have accumlated in a lump sum on your final day as well. Most companies do that if you have unused vacation time--at least all the ones I have ever worked for did.

Something is just not right and I would not let it slide...I would keep calling and trying to get answers from the bank about what is going on or else you may have to take them to small claims court. Sometimes just the threat that you are going to do that will get them moving to act and do the right thing so they don't have to involve the courts. Good luck!

See if there is a number of total hours on your last paycheck. If not, divide your gross pay by your hourly rate to calculate how many hours you were paid for. Many companies, on your last check, will pay you for the full pay period plus the extra days you worked at the end - see if you really got paid for the last half of June plus the extra days you worked in July. It wouldn't show on the timecard part of your check stub, but would show in the total pay. Was your paycheck higher than it usually was for half a month? If so, that's probably the reason, and you probably did get paid for the extra days.

Under the Fair Labor and Standards Act, you are entitled to pay for the hours you work. You will need to contact your state's department of labor and industry and file a complaint with them since they are the appropriate agency to deal with violations of the FLSA.

In terms of your vacation time, kiss it goodbye. Vacation Time (just as PTOs ) is a benefit, not an entitlement, that nearly all companies terminated after the employment relationship has ended. The exception to this is if you had a written employment contract that includes you vacation days with the option of buyouts as part of your total compensation package.

you could definitely take this up with L&I or even just going to their website is helpful. I know that they can be really hard to work with some times, but that is only because people are always trying to scam them out of money that those people don't really need. But if it is about getting your pay from your work place then L&I can definetly help you. My Husband was in the same situation and he told the people in HR that he was going to contact L&I to help him get things straightened out and he ended up getting his pay check really quickly after that. You have rights and let the government work for you. Go Get 'Um Girl

When you go to the lawyer, also take your first check to show that things were always 2 weeks behind.
