All right, in my latest battle with my ex wife, she has filed even more charges against me. The local police department called me and had me come to the police department to answer questions.To take care of this I had to drive downtown and answered the questions. When I got in my car, they were watching me and pulled me over for not having my license. My question is ==Is this entrapment? they had no reason to pull me over, they just did it and then wrote me out a ticket.

You should have received more than one citation. The probable cause citation, and the one for no license. If you knew the Police were watching you, why were you driving? This is not entrapment.

It is not entrapment, but it may be an illegal stop.

If they knew you did not have your license, they could pull you over and investigate.

If not, then they need some articulable suspicion of illegality to legally pull you over. They will probably say they witnessed an illegal turn or a broken taillight. Once they pull you over, they can ask for ID.

If they have no reason to stop you, it is an illegal detention, the request for ID is invalid and the offense should be thrown out.

Is it entrapment? - Not even close.
Entrapment - Action by law enforcement personnel to lead an otherwise innocent person to commit a crime, in order to arrest and prosecute that person for the crime. (Notice it does not say an inaction)

If the police knew that you did not have a license they had reason to stop you, for driving without a license.

They asked you to come to the station, they did not tell you to personally drive there.


To be entrapment they would have to do something that would cause an innocent person to commit a crime.

You knew you had no license but you drove anyway.

Entrapment - no. You were driving without a license, they knew it, they stopped you because they knew it, and you got a ticket because you need a valid license to drive.

Someone else could of taken you (family, friend, cab, or bus.)

1st, why did you not have your license? That shows pretty bad judgment.

My wallet is a piece of clothing and my license is within it. It is the law.. If you have a history of domestic abuse, alcohol abuse, drug use, criminal record, you can bet the cops pay attention to you if someone swears out a complaint.

Get and stay under the radar. Don't answer her except through your attorney. End it there.

Assume the asked you to "come to the station", but didn't specify how you should get there. It would only be considered entrapment if they told you to drive downtown.

i seriously doubt the same cops that told ya to come to the station were the ones that stopped you. and doubt they knew anything about it. and doubt they were waiting on you because of you not havin a license. cops are everywhere

If you do have a license, and just did not have it in your possession, the ticket will be dismissed by a judge.

If you are unlicensed, your argument will not fly.

If they knew you were driving without a licence, yes they can pull you over.
