Kevw25 pretty much hits the nail on the head. Most states recognize 16 years as the "age of consent" when dealing with sex and dating issues.
When engaging in sexual activity with an individual under the age of 16 years....then you have some serious issues.
There are primarily two issues when dealing with "minors." The "Age of Consent" and "Age of Majority" or emancipation.
The latter being when a person is no longer dependant upon parental control.

It sounds like you have a good kid and a good relationship. That's fantastic, but let's start with the facts: Realistically, you can't forbid her to do anything without infringing on her burgeoning autonomy. If you give her a flat out no to seeing this guy, regardless of how inappropriate you feel he is, your daughter will, at least resent you and will, at most, shut down, stop communicating and sneak around behind your back. This doesn't mean, however, that you need to turn her loose to make unguided and possibly unwise decisions. This would be equally disastrous. You and your wife need to sit down with your daughter and speak frankly: Start by leaving this particular fellow COMPLETELY out of things, but ask her what qualities are important to her in a boyfriend. Ask her why these qualities are important to her, then ask her how this fellow has, thus far demonstrated them. I'd then tell her about your concerns, because they're certainly valid. Keep to the facts, however. Don't make any remarks about this boy that could be construed as attacks on character as this will only set up an us-against-them mentality. Finally, if after this conversation she's still intent on dating him, set up some ground rules - curfews, appropriate date locations, etc., and it's perfectly reasonable for you to ask to meet him prior to a first date. Regardless, this particular guy will probably be a passing fancy - how you manage this situation is much more important in the long run. Use this opportuntiy to show your daughter that you trust her to make good and responsible decisions, and you'll reep the rewards.

This is such a cliche! 18 is not the new 17. You are like the only person to ever invent this idea lol
i'm not sure this is the right call, you are rocking the cradle... both of you are still young teens, your not 21 which is already a legal adult that can legally do anything in any state. I hope i didnt come off harsh, i was doing my best to explain myself, be careful out there, take care

Nope, the age of consent in most states is 16, and most states allow for relationships between minors (under 18) and people close in age to them (18-22 year olds). It varies by state, however I wouldn't worry about it because the police, prosecutors, and courts all have discretion and wouldn't normally interfere with a consensual relationship because of a minor age difference, even if it violated the law. The police probably wouldn't arrest one on that charge, even if they did, the prosecutor probably wouldn't charge, even if he/she did, the court most likely wouldn't convict.

If she has sex then she could have trouble. I've heard of males being charged in these circumstances but never a female. I'd guess nothing would ever come of it at all. As for age of legal consent for Il it is 17. That info is available on any web search. google for yourself.

If you're talking about dating, there's no problems at all.
Freedom of association, etc.
If you're talking about sex while on the date, well....
It depends on the laws of the specific state you're in.
In some states, 18 & 16 = trouble.
In other states 18 & 16 = perfectly ok.

It is 16 years of age and or 3 year difference before she would get in trouble. For her to be in trouble she would have to be 19 years of age.

I would think that it would depend on whether or not she has sex with him and the laws on statutory rape. He may not press charges, but his parents might be able to.
