**BTW: The chances must not be very slim, because I've done it, and it was quite easy. I must go now, the cops are at my door...

There is no penalty if you are successful.

But if you try to evade and he eventually pulls you over, or if he gets your tag # and shows up at your house tonight, the charge becomes Resisting Arrest.

Penalty For Evading Police

I would say that the penalty for successfull evading the police depends on the State in which you commit this act. In NY, particularly NYC, Highway Patrol vehicle's are equipped with cameras. Every good HP Officer is going to zoom in on your license plate #, so as to be able to further identify the vehicle.

So, even if you do get away, it's temporary at best (unless the car is already reported stolen). The penalties can range from: Disorderly Conduct (Causing Public Alarm - a violation), Resisting Arrest - a misdemeanor), Obstruction of Governmental Administration - a misdemeanor), Reckless Driving - a misdemeanor), Reckless Endangerment - which be a misdemeanor or a felony depending on the circumstances of the pursuit), Fleeing the Police - also a misdemeanor or a felony depending on the circumstances).

This is not including the initial violation that the Officer was trying to stop you for. Also, if your foolish enough to have retain any illegal items in your car, then those charges would also be included. Oh, and the forfeiture of your vehicle for use in the commission of a crime.

As a story of note: I had 1 young man run from me in a Mercedes Benz 2 years ago (100mph in a 50mph zone was the initial traffic infraction). It took me 1 year, 11 months, and 27 days to catch up to him (3 days shy of the statute of limitations), but catch him I did. He had no idea I was still looking for him and was completely surprised when I knocked on his front door.

Felony evasion, Resisting arrest, disorderly conduct, failure to obey a peace officer, stuff like that. Not to mention every traffic law you break. It's really not worth running even if you have some marijuana on you. At most you will get a speeding ticket and spend a night in jail. If you run, you will be caught, and you will spend a lot longer time in jail.

If they got your plate you cant outrun a radio. Hey maybe you will beat the rap if you get killed in a wreck while evading. If you like to be able to say you pulled one over on someone, become a used car salesman or and insurance agent.

When they do find you, definite jail time. Why do people ever run from the police? They're *going* to catch you. Haven't people ever seen the show COPS?
