Debtors deposition help me?
Twice I ignored a creditors depo meeting . now they have a warrant for my arrest. thought there was no debtors prison. i know i screwed up but this is a civil matter not criminal. owe about 25000 and dont have it .was my be smart mouth a factor.cant even afford bankruptcy.can they punish me?

Ill follow the rules from now on. so far good advice . my folks and gf dad will take me to the shed when i tell them in a few hrs but good advice

When the court says you are supposed to attend you WILL attend or go to jail...period. So yes they can punish you because you ignored the judge. What you should have done was either appeared or responded via document to the court.

Here's the deal, and you did mess up. A person doesn't file for bankruptcy unless he owes over $65,000, or unless he owes a lot more and it's because of medical bills.

You should have phoned Consumer Credit Counseling and never filed for bankruptcy. And if you get back in the courtroom tell the judge that you didn't know how to cancel out the bankruptcy because you thought you'd be better off going thru the CCC. And then follow thru going to CCC if the court will let you.

If the judge determines that you WILL file Chapter 13 then you will have to find yourself an attorney who will help you set up the plan according to the law (and that attorney will tell you what you can keep...like a house...and a car worth less than $500 or something), and then perhaps you will be able to pay part of the attorney's fee (or maybe all of it if he agrees) from the bankruptcy 5-year repayment plan.

Just tell the judge you didn't have any or enough attorney intervention and that you were stupid AND THAT YOU APOLOGIZE. That will help you a lot.

Are u talking about a bench warrant to bring you to court? Usually when a creditor files a judgement and the defendant doesn't show up or hire an attorney they automatically lose. ONce the judgement is filed, depending on how much you owe, your assets may be taken or your wages garnished etc.

I'm not sure I fully understand the question asked. Can you be more specific about the debt and the warrant.

They can arrest you for the Failure To Appear. You will probably have a bond amount on the warrant. Call a bail bondsman to get that amount. They are not obligated to rat you out and probably won't, seeing they want your business. If you are in the US, and it is a misdemeanor or less, you can flee the state without worry, as they only extradite certain felonies. Once you are an "out of state resident", get it quashed as such. Consult a lawyer in your present (or future) area for further details. Many of the details you need will be given up for free in the intitial phone conversation. Make sure that this consultation is free.

you should have never ignored the meetings cause they are there to help you but not you have a cival lawsuit out on you for not going to the meetings which they can hold you for . remember there is lay away or the old saying if you can not buy it you do not need it . yes they can punish you and bankruptcy there r different chapters you can file you have chapter 7 and chapter 13 you need to look into them fast
