So, here's my question! My husband (who's in the navy)cheated on me and is going to Court Marshall for it, I don't know the process and was just wondering if anyone knows what happens? What do they do? And what can happen to him for this offense? Thanks in advance!

ok, let me add some details since people are calling me a liar... he cheated on me got a girl pregnant... has stopped my support for my child and has been to captains mast 2 times and court marshall once already... so there it is.... he really is going!!!

First of all are you positive that is why he is going to court martial? second, he can be discharged with a dishonorable discharge (makes finding good work down the road much more difficult), he can be fined a large amount of money, he can be demoted to a lower rank, he can be forced to serve time in a prison. He should be seeing a military defense lawer, if you can, go with him the next time he sees the lawer and if your husband consents, you can ask all the questions then and there. Normally something other than infidelity is required before they will court martial someone. I suspect he might have partaken of another military member that is in his same chain of supervision thereby making it much worse than just infidelity. let me know more info if you can and I will be better able to advise you. see his defense lawyer asap and ask all the questions. If your husband will not let you see the lawyer, I suspect it is for more than just innapropriate behavior with another person outside of your marriage. I wish you luck and if he did go with someone else, I have no pity for him whatsoever and nor should you. You deserve better.

We really don't know the circumstances, so it's difficult to presume what'll happen.
If he's being charged with adultery, then more than likely, they're going to want your testimony or some form of official statement as evidence.
The most they can do is throw him in the brig, reduce his rank to an ensign (if officer) or seaman (if enlisted), take away his pay, and throw him out of the military.
It does seem odd that such a thing would go all the way to court marshal and not just NJP him under the UCMJ.

Yes, the things you mentioned are a possibility. Nearly all the violations listed in the UCMJ allow the military court some latitude when assessing penalties. After serving whatever penalties the court may assess I would bet that he will be let go, probably with a "less than honorable" discharge, sadly, a blot on his record that will follow him the rest of his life. Usually when someone is put up on Adultery there is something else accompanying the charge. I think that it is rare for the act of Adultery to be prosecuted alone, especially if it went to Court-Martial. As for the actual punishments I think that the best person(s) to ask is the JAG lawyer handling the prosecution.
EDIT
To support my case think back to poor PFC England. She was also charged with Adultery, but after being involved in the Abu Gharib fiasco. Your additional details are proof enough he is being dinged for his impregnation of another woman. CPT's masts and another Court-Martial indicates that he is probably being charged with disobeying of an order. (Highly likely in my opinion.) That is a whole different ball game. Very serious charge.

yes, forget what everyone else said. it is is a mast offense.but it sound's like he's a dirtbag and someone is really out to get him,because it should'nt go to court marshal. since you're still a dependent, i would go to navy legal and get all the details, because im not a lawyer, but i know enough from past experience. he might get brig time, or just get kicked out, and also if he's been in between 6-12 years, he might get lucky to get a general discharge, but he's got to get a good laywer, preferably civilian. i'd suggest prepaid legal, because it sounds like even though he did what he did, you still care about him, so good luck. p

I don't now why so many people are calling you a liar. There have been several high profile courts-martial for adultery and many that no one outside of the unit affected ever heard of. I admit it is rare though.

the Summary CM is most likely for something other than the adultery, since that is never prosecuted unless it is in conjunction with something else.
expect anything from RiR, forfeiture of half months pay from 1-3 months, Brig time and probably a Bad Conduct Discharge.

the most likely reason for the court martial is if he cheated with another married officer.
Technically he can be charged and serve time in a military prison, the most likely outcome however is he will be forced out of the navy.

Courts martial over adultery? Never heard of such a thing. Military Courts Marshalls are for breaking Military law, not about civil law. If you want a divorce, see a lawyer.
