If someone hits your car in a parking lot & you find out who it is...?

and make a claim to your insurance company with pictures included do you have to pay your deductible? this would be considered a hit & run right?

i believe it was someone who lives in my apt & parks next to me. if i see my paint marks on their jeep that coincide with the paint marks on my car, i will take pics & knock on their door & get their ins. info.

Your deductible must still be paid. You need to file a police report using the pictures you captured, and take the person to small claims court to recollect your deductable. Mind you, you'll probably win the judgement, it's another thing all together to get the person to pay. Letting your insurance company know will allow them to go after the person too.

so do u just think u know who it is? did u file a police report? can u prove who did it? if not, it's a hit & run but you're still going to pay your deductible. the only way out of that is if u have a police report stating who hit your car, get their ins. information, and then your insurance co. would go after their's f/ the repairs. i'm pretty sure that's not what you're saying though, so sounds like you're gonna pay.
