WOW!!! and the reason they didn't just take him to the bar and ask him to do the hibbity jibbity is why? I'm not sure why that particular person felt they needed to do that, but I would constitute that as rape. (Unconcensual sexual activity) The gun thing really concerns me as that is going just a BIT far... I would recommend to your buddy to talk to someone about it as he is the victim in this. Best wishes!!!

In NJ this would not be considered Sexual Assault (the rape charge in NJ). Sexual Assault requires penetration of some sorts. Unless there was some sort of penetration, but it wasn't mentioned in this scenario.
"c. "Sexual penetration" means vaginal intercourse, cunnilingus, fellatio or anal intercourse between persons or insertion of the hand, finger or object into the anus or vagina either by the actor or upon the actor's instruction. The depth of insertion shall not be relevant as to the question of commission of the crime;"
It would even be difficult to charge them under Criminal Sexual Contact since sexual contact is defined as an intentional touching by the victim or actor, either directly or through clothing, of the victim's or actor's intimate parts for the purpose of degrading or humiliating the victim or sexually arousing or sexually gratifying the actor. Sexual contact of the actor with himself must be in view of the victim whom the actor knows to be present.
Criminal Sexual Contact is a specific intent crime that requires the actor to have the intent to degrade or humiliate the victim or sexually arousing or sexual gratifying the actor. In this case the act was committed to steal the victims semen.
The peson could be charged with Criminal Restraint without a doubt. Other charges depending on the scenario could be Burglary, Criminal Trespass, Theft by Extortion and any weapon violations that apply.

It sounds too much like a common porn fantasy, and a rather boring one at that. So I won't exert myself by going into excessive detail as my colleagues here have. Hollywood seems to think that guns are sexy, but the average man who actually has one pointed at him is going to have trouble getting it up for at least a year, much less later the same night. To put it simply, the answer is yes. Reactions in the male parasympathetic nervous system do not rise (ahem) to the standard of consent under the law.

Well you have menacing with a lethal weapon to start and you have a criminal assault, you have sexual molestation. One could go on, if what you have said constitutes rape or not would be difficult to prove without absolute evidence. If there was no penetration then I would think that it was not rape. If for instance you drugged a woman removed her clothing and interfered with her privates without actually having any sexual contact apart from touching with the hands would this be considered rape, I doubt it. Normally rape would be unconsentual sexual intercourse vaginally or anally. The fact that they took his sperm without his permission would be a violation anyway. If this is a real situation then those women could find themselves behind bars for a very long time. I could see no exonerating circumstances as to why they should need to do that to this guy, he has been totally violated, and the fact that they used a gun to threaten him with is quite menacing.

Wow, that's a new one. Well, it would be sexual molestation or sexual assault actually not rape unless they forced him to have sex with them. If they only forced him to ejaculate it would be molestation or assault I believe.
Either way, this guy had a crime committed against him and he should have reported it to the police, but he was probably too embarrassed to. Males usually do not report when they have been victimized.
Why was he asleep for an experiment? Was it like a brain wave or dream experiment? Just wondering. Was he tied down for the experiment or did the women do this to him as well - if they did they are also guilty of falsely imprisonning someone and holding them hostage. They could also be charged with assault with a deadly weapon.

Yes, this is rape. If a woman took his sperm without sexually assaulting him (for example, saved the condom after they'd has consensual sex) and used it to impregnate herself, that would be at the very least theft and a gross personal violation. But the crime you describe isn't "just" the theft of sperm and the violation of his personal rights--it's absolutely rape. If this is true (and not just a joke) I hope the women are caught and punished to the full extent of the law.

If he didn't consent to sex (which even masturbating is) and they did it anyway IT IS RAPE! No concession to the fact they were women and he was a man. He was bound, and they touched him sexually, and they STOLE something from him - HIS CHOICE.
I would support your colleague in going to the police and making these female RAPISTS face the full force of the law.

It is quite clear that it was a rape.the both man and woman do this when ever sexual emotion over power them.In this case ,it is not only rape but also involves many other crimes. The method of taking the sperm has not been mentioned,if they got it technically, without inter course then it cannot be named rape but it is crime.

Your co worker has without a doubt been the victom to sexual assault.
If they wanted his sperm they could have just asked but instead they assaulted him and embarrased him and took it without asking.
That is so wrong i cant even believe that it has happened.
I hope they make a full investigation and find the person who did it and put them in Jail. it is WRONG!!
