my brother and i were in a car accident last week. my brother was at fault and he was driving one of my parents cars. insurance is going to pay for the damage and medical bills for the other person. i haven't discussed with the insurance company about them paying for my medical bills or pain and suffering ( whatever they call it). my parents have 50/100/50 and they have $5k pip ( personal injury protection ) . So my question is this will the insurance pay for my injuries and my brothers injuries ( medical bills ) ??

2. If your state allows for GBI claims then you have an open bi claim agains your brother. Any settlement is offset by what is paid under PIP. Ask your adjuster if you are able to file a GBI claim, or guest bodily injury, claim.

We really need to know what state you are in order to tell you if you will be able to an injury (pain & suffering) claim against your brother.

Assuming that you and your brother were using the car with permission ( or had implied permission) in most states states you as a passenger can make an injury claim against a family member who was at-fault.

The PIP coverage will apply to you and your bro no matter what. However, he will only get his bills paid. He will not be allowed to make a claim for pain & suffering.

You really need to call the adjuster and discuss your options with them.

You wont get any money beyond medical bills. You cant benefit from your brothers at fault accident- your a household resident and family member.

If he has 5k PIP on his policy (assuming that means 5k per household resident) you will both get up to 5k in reasonable medical bills paid.

haha.. thinking you were getting pain and suffering money off your brothers policy? how selfish is that?

Your policy will only pay out up to your coverage limits. From your response above, it sounds like you can each have up to 5k for medical. It is hard to say exactly without seeing your full policy. I hope everyone is ok.

I hope you don't expect any money any time soon if you get any. Deductibles need to be paid out and then you have to wait FOREVER to get anything back.
