i know there are the pro-bono representing veterans with their problems withe veterans administration but i was wondering if there are any attorneys that will represent a soldier who is the victim of malpractice and substandard care while in the army medical system.

actually its my son, he had a bone scan done in may that showed he had two fractures one of the tibia and one of the femur, the army doc's didn't 'see' but caught the tibia fracture in late june and just two weeks ago one of the doc's when re-evaluating him said that the two fractures showed up in may. so he's been trying to train on a fractured tibia and femur and he is now finally at the first of july put into physical therapy/rehab but they have done no treatment at all. we can't even get him home to get him treatment. i have written all my government officials, the dod everyone but they just keep ignoring it. they play games too like giving them passes but then revoking them at the last minute. we've been on our way to see him several times and been half way there when we get a 5 second phone call telling us he didn't get it. they give no reason for the whole company losing their passes. its like they enjoy making it tough on the injured ppl there.

DESERTVIKING - how do you get them help, i assume he's going through the process because he is now in PTRP but they tell them one thing one week another the next. i am very concerned that by ignoring his fractures they are causing further damage, possibly permanent to him. and i can't get him out on pass to get him to a real doctor. also you can't call down and as for help because i tried a few weeks ago to call and ask if a chaplain would go pray/support him as he was having a tough time, when the chaplain asked me what his problem was i told him and the guy went beserk on me, screaming and yelling telling me my son was lying and such. my husband came home from work while i was on the phone and could hear the guy yelling from the doorway. i just don' t know where else to turn and how to get him help. fyi: he loved the army and wanted to stay, he just got injured and thats when all of this started.

Contact your Senator or Congressman regarding the substandard care you received while in the care of Tri-Care. I know that there are many politicians who are concerned about the lack of care and the malpractice. The thing is that since you are active duty that many lawyers will not touch your case with a ten foot pole because it's a case that a lawyer can not win. You could try your own Army legal system to see what your options are and what you can do to rectify the situation; not a heck of a lot! I commiserate because I was misdiagnosed by Tri-Care doctors for six months!

Your son can't sue the Army or DOD for sub-standard care. He can only go through the disability evaluation process and accept the findings awarded to him. It's called the Doctrine of Sovereign Immunity. If you do find an attorney and he is not aware of that, walk out of his office and don't pay him a retainer because he fell asleep in his law school class room.

you cannot sue the government, they have even stopped giving people the sex of the baby during ultrasounds to avoid all of this. i don't think it's so much military hospitals it's the luck you can get even in the civilian world with people not catching something. a friends g-ma was going to her doc for 2 years complaining of headaches went for a second opinion and they discovered it was a brain tumor.

Unfortunately you are one of many experiencing this. My son had to get his own MRI to prove to the military they were not giving him the proper medical care he required. After the M.R. I. proved his had a problem requiring surgery, they did surgery. Then he had to fight to get them to pay for the M.R.I.
Contact your congressman or woman to help you. It is an on going battle and it is wrong for so many reasons.

I would try some Veterans associations, they should be able to help you even though you are still active.
