Yes it is illegal. Its called the rule of seatbelts, you can have as many people in your car that you have seatbelts for.

It is not only illegal, but stupid. If you were in an accident, that child would become a projectile, killing not only himself but others in the car.

Even if you have a child in the seatbelt with you, that child will suffer severe seatbelt syndrome. GRUESOME PHOTOS http://home.grandecom.net/~amylj/carseats/doublebuckle.jpg That is seatbelt syndrome. THAT will happen to your child if you put them in your lap and put the seatbelt over them.
If you child weighs 50lbs and you are in a 30mph crash, that child turns into a 1500lbs object. There is NO POSSIBLE way for you to hold 1500lbs on your lap.
A child needs to be in a booster or car seat until 4'9" and until they can pass the 5 step booster test http://www.carseat.org/Boosters/630.htm . IF you child is under that, they NEED TO BE RESTRAINED!
You need to take 2 vehicles if you are traveling somewhere or purchase a vehicle with more seating locations. In Texas, seatbelt law is primary, so a cop will and can pull you over for having too many people in a vehicle without an adequate number of seatbelts. If you child is under age 5 or 36" tall, you will get ticketed for non use of a child restraint.
Be smart about this. Don't put that child's life at risk b/c you want to sardine a lot of people in a car.

This is illegal. Texas child passenger safety laws require children younger than five years of age and less than 36 inches in height to ride in an approved car seat or booster seat. Additionally, Texas law states that during the operation of the vehicle, the child must be properly secured in a child passenger safety car seat system according to the instructions of the manufacturer of the safety seat system. Children under age 17 must be buckled into the vehicle with a seat belt. This law changed on Sept. 1, 2005. The new law increased the age requirement for child safety seats from four to five.

Totally illegal! Kids are required to be in seat belts. Driver and parents will both be in trouble for that one and that's if you are pulled over. Just imagine how much worse it will be if you are in an accident and the kid goes flying through the window. Ugly. Probably anyone over 16 would be charged in the accident for not making the kid wear a seat belt. Too many bad possibilities with this one.

yes it is stated here in Texas and just about any civilized state
[excluding west Virginia} all passengers are required to wear seat belts as a safety issue and will give out a ticket, or at least have cause for stopping which in return will give then probable cause to search say vehicle....
good luck..its like holding a child not in car seat.....

Well I live in Texas, and wherther it is right or not, you are endangering the life of the child due to your own error!! I think there should only be as many people in a car as there are seatbelts. Anything else would be just plain foolish!!

The size of the car is irrelevant. Insurance policies cover the number of passengers irrespective of their size. A babe in arms is still a person just as much as a 6' 6" giant. In the event of an accident your insurance policy would be void and all damages and compensation not to mention fines and criminal proceedings would be your responsibility.

Depending on the age of the kid from what i know its illegal to hold your kid in the back seat of its under a certain age.
Its a car seat law just like the seat belt law. even if your in the back seat you still have to wear a seatbelt

I dont know about Texas but in California it is definatly illegal.
To be safe, you want to have each passanger to have their own seatbelt.
