a Finch...or some people call them
"wild Canaries"...they are yellow and black
and sing beautiful songs...you can put up a
thistle seed feeder to attract them.

Sounds like a sparrow.
It's illegal to remove the nest.

it could also be a house finch (not as small as pet finches but small)
