If my mother receives New York State benefits and she can no longer receive them under her name, is it true that she can receive her benefits under her childs name? Is it her benefits, or legally her childs?

I agree with the theory of "I'm not a lawyer, but....."

Something doesn't sound right. If you are entitled to benefits, you should be able to get them under your own name.

I am not a lawyer or anything but common sense would tell me why can't she get benefits under her own name. If she receives any type of benefits "under her name" the benefits are to help the household. I have never heard of benefits going under the child's name not unless the child has a disability and if that is so the check would go into an account specially titled for the child and she has to provide information of what she did with the money for the disable child.

You would need to talk to a lawyer about this. There are free services that you can contact. Look in the telephone book's yellow pages under lawyer or attorney referrals.

If you are under 18, the money would still be handled by your mother because she is housing and feeding you. Once you turn 18, you are on your own.

i dont' live in NY so don't know

you could call the state benefits department and ask if you could get information from someone.

simply ask if a person can collect benefits for their child, in their child's name?
