A bit yes.

It is a little issue, but I think that paying for a 200 dollar game and trying it out and not being able to return it would suck.

Trying it out is alright I think, still illegal bottom line.

Well personally it depends on the company that makes that software. If it was some big company like microsoft or adobe or kaspersky then i think it's okay because they have a rather large revenue and so me downloading a pirated version of their software won't have an impact on it. On the other hand if the company is a small business then I would feel bad for downloading a pirated version and so end up buying it coz me downloading a pirated version of their software could have an impact on the company and in the worst case scenario the company could get to a point where they have to close down.
Like i said, that's my own personal opinion.
