In the state of NC when an atty fires a client I know he must go thru the courts to be relieved of the case, but how long does he have to do that? Let me give some background..Currently in custody battle. The ex's atty has fired them since April. My atty says he cant proceed until the court order is receivd that relieves his atty of the case. How do we proceed and move forward?

An attorney does not fire a client -- either the client fires the attorney, or the attorney withdraws from a case (often requiring court permission).

But when an attorney withdraws, with or without court permission depending on the circumstances, the other party has the option of proceeding without an attorney or hiring anew attorney.

The court will rarely grant more than a minor delay for the party to do this -- but because of full court schedules, a hearing may get pushed back several months (as in your case).

You just proceed forward -- the other side either shows up, with or without an attorney, or they don't.

Attorneys can't fire a client, as the client doesn't work for the attorney. Whether or not your ex has an attorney has nothing to do with your ability to proceed with the case.

Contact the Judge hearing the case and ask him this question, he will know more about this than I do. If it is on a docit for him to hear his office can tell you.
