My girlfriend tourist visa has expire she is going back in ASIA she is worried that she can be detaine at airport because she overstay her visa.
Can sombody tell me if they ( immigration) will arreste her on her way back to ASIA at airport ?
She has allrady buy her airline ticket.

overstaying a visa is usually a fine. not that big a deal. of course things have changed in america, so... .

Although it is possible to fine her $50, If she has a current passport and a valid visa for where she is going, it is most likely that the officer will stamp her passport and take her I-94 without even blinking. Allow extra time just in case.

The real issue is, if it is over a 6 month overstay, whether they will allow her in again since (though waivable) she is technically subject to a 3-10 year bar on re-entry.

She needs to go to Immigration before she leaves and pay for an extension and any fines, if she waits until she gets to the airport she could miss her flight and then it will cost more.

I do not know why do you call American immigration and ask them.? do not call from your home or cell phone. Get the information straight from the source.

of course they will arrest n questioning her.she need a good reason for overstay.there will be a fine to pay.
