So i should be the one getting the money rite since i had a phone line that i bought under a friends name.. all this years i was the one paying the phone bills.. so when the line was cancelled upon my request .. there was an excess payment of nearly $500 to be refunded to me.. however, since the phone line was not in my name, the cellphone company issued the cheque under my friends name. so i had asked her to bank in for me and return me my money.. talked to her before all she replied was," the cheques was in my name... sooo...",
and now its been nearly 5 mths she has yet to return me the money.. i called her a few times but always unavailable.. i.
i was so pissed off...

tell me what should i do..

if you can prove that you were the one paying the bill, ie.. cancled checks or reciepts, then you could probably take her to small claims court for the money, I would say your friendship is already ruined. if you cant prove it then I would say that you are just out of luck

Why on earth would anyone overpay a cell phone company nearly $500? And why didn't you get your own phone in the first place? I'd say she was a good friend, though not the smartest, to put her good name and her credit on the line for you. Something tells me there may be another side to this sad tale.

Meet her at her house, but don't expect an invitation. You'll just have to come over and ask if you can talk. It'll be alot harder for her to slam the door on your face then to hang up on you. Tell her how she is stealing the money as it was a refund for a payment you made. After a face to face confrontation ask her to come to the bank and to lunch with you. If she is excessivly difficult remind her how you could take this to court and get more then 500 out of her. (That usually smartens them up). :)

If a friend would have the balls to take your money from you in such an immature way then it's for the best that she isn't going to have your friendship.

If you can prove you paid the bills then you can take her to small claims and get the moeny back. however you are looking at court costs.

why were you paying for it in the first place? If you thought she would pay you back, then i'm sorry but you were wrong. I wonder why you were covering her ***, when she dind't care enough to cover yours.

Money is money, and you should learn a big lesson from this incident. I am afraid that you will not ever get the money because the check was made out to her. What proof do you have that this money was supposed to be yours. You should really think about getting some new friends, and do not go into a telephone account with ANY of them. No one is your friend when it comes to MONEY.

If you have checks made out that you sign, that you actually have been paying the phone bills, bring copy's to court, the court should make her pay you 500$ if you can prove you been paying them phone bills.

I would take her to small claims court. She is not entitled to the money. Although, she was a friend to let you use a phone in her name. Maybe, you can make a deal for half.

there is nothing you can do about it honey.
you have just lost a cheque and a " friend "
thats not worth having or calling " friend "
some people are like that, now you are a little bit wiser !

well I am sorry but it seem to me that the money is already spend, and there is not much to do about it. Next time, take the line on your name.

hmm, yes you are the one entitled to the check.... however the account WAS in your friends name so therefor the check was issued to her... not sure if theres really anything legally you can do. She's not much of a friend though if she doesnt give you the money.
