Pen guns have been around for 60-70 years. Calibers vary and many are homemade. At least in Illinois, they would not be legal. Some are very finely manufactured. The last thing I saw close to one was a pen gun that fires .32 caliber tear gas cartridges, when I first started on my Police department. About the same time they also made a 12 gauge tear gas night stick.

pen guns have been ariound for a while really. They went from spy type weapons to collectables. There are still some being made, I see them advertised once in a while. For any firearm that is carried concealed, or is not readily identifiable as a firearm, requires you to have a concealed weapons permit. Also, pen guns are outlawed in many states. Only the ATF can give you a good answer for where you live.
