my only child is a girl and is 14yrs,and the child i want to adopt is also a girl and 7yrs old whose parents the family dont know their whereabout,she has been living with a lot of people,different people all the time for the past 5yrs.

Well, it totally depends on where she is now, and who has custody of her now. Is she in state care? With relatives? Foster care?

In any case, both of the birthparents rights have to be terminated first. This takes an attorney or Protective Services, depending on where she is now. If their whereabouts are unknown, a diligent search has to be done for them. FYI, almost anyone can be located now days. It is so important to make sure that these parents are truly looked for by a private eye or other search agency -- to insure that the judge will terminate their rights, and most importantly, to make sure their rights are honored. Otherwise they can legally come back anytime and seek custody of the child.

After the parental rights are terminated, then you can adopt. You may have to get a homestudy as well. The cost of a homestudy is around $500-900 and the termination hearings $1500-$3000 and then the adoption is around $1000-$2000.

All of this of course depends on the state you live in and the attorney you go to.

If no one has Legal Custody of this child, whoever has the
child, can allow her to be with you, and you can hire a
lawyer and file for Guardianship of the Child...the lawyer
will first file for immediate emergency guardianship, based
on the fact that the parents are not available, and that you
want to take responsibility of the child.
It is not so difficult as you think.
Getting Full Guardianship is Easier, than beginning the
legal procedure for Adoption....and it might be less costly
too.
It shouldn't cost anything to consult with an attorney, but
if I were you, I would do this soon...for the sake of the
child, who needs a good stable home...

call a family law attorney, she may be considered an abandoned child and therefore the parents have forfitted their rights. You will likley have to file for custody first, then for adoption. But call a lawyer, it makes everything easier and they can make sure that the parents wil have no claim to get her back 5-10 yrs down the road. Good luck

Go to a judge and ask to be made guardian for this child to prevent her from being bounced around. At that point, you can then work at determining how to go about adopting her. Different states have different requirements if both parents are missing, but certainly abandonment has to be proven and is a cause for removing parental rights.

You can have her move into your home. Then petition for adoption. You must run an ad in the last known city which they resided in, to inform them or attempt to inform them of your wishes. With them being gone for so long without any contact your attorney might even be able to have the courts forfiet their parental rights. This is how my parents adopted my nephews.

You can contact your local human services agency to see how you should go about adopting her. She may not be considered free for adoption unless her parental rights have been terminated.

it is nice that you would like to adopt her.......it is not easy....
but i guess it all depends where you live. Get a lawyer, you will need one at the end anyway. A special lawyer that deals with adoptions! Do your homework on it, don't just pick anyone just because he is cheap....
