If you commit a war crime or anything while you are enlisted and get convicted and found guilty, do you get sent to any federal prison or do enlisted personnel go to a special military prison?

Also what do you guys think of the marine that was recently found guilty of murder in iraq and was sentenced to 15 years?
I think its embarrasing how a low life pos child molester can get 5 years or less but someone who was fighting for their country can get 15 years.

I am not saying that was he did was right cause it was terrible, but who are we to judge when most of us dont understand what these guys go through everyday in the desert.
I just think that justice in this "free" country is sometimes RIDICULOUS

Just so there is no confusion, I am NOT talking about the Army soldier who raped the young girl and murdered her whole family (he should get the death sentence)
I am talking about the Marine who ordered his fellow Marine to execute an Iraqi while they were looking for insurgents

If they have commited a crime while serving there are 2 options.

If the crime was commited in cilivian "world" like rape of a girl or armed robbery, they can give them to the civilian side and such. And they can be tried under that.

But in cases like war crimes or military affairs, they can be tried and convicted because of codes of conduct by the UCMJ.

Sometimes what other offenders get are not as harsh as some would want them to be but that is our court system. Sometimes unfair as it is, it is ours. I believe that if a military member commits a crime while deployed of course the circumstances need to be looked at but then again, just because they are there doesnt give them the right to do as they please.

I find military court Marshall's are often self serving, and attempt to protect the services, first!

This last verdict that convicted a Marine sergeant of murder, is troublesome. I can see that he possible made a mistake and killed the wrong guy, hell that happens every day in combat. The fact that he tried to hid the fact is what did him in, that and his own squad members testifying against him.

I believe a verdict of murder is over kill. Forgive the pun. I could see manslaughter or involuntary manslaughter, more accurately. The fact that he was on a mission to kill someone should exonerate him from voluntary manslaughter. his crime was mistaken identity. On a mission such as this, adrenaline is rushing, the target is also the hunter, there's little chance or time for error. He got the wrong guy, but murder? I think not !

They will send this young man to Leavenworth Kansas, the home of the federal penitentiary. where fifteen years, means fifteen years !

most military prisoners go to Federal Prison where they have got to do 85 % of their sentence, they are made to work a min, of 8 hours a day in prison industries, UNICORE, THEY ARE GIVEN SUBSTANDARD MEDICAL, FOOD, HOUSING ECT, in essence they are not on a holiday as some people try to insinuate,
I also think it is so stupid for some people to want to punish some one for things so severly , that happened in a war zone,why are our people held to such higher standards when our enemy has no standards, what would be the punishment had this been Alqueada who had killed and raped ? are we trying to prove our college professors are liars when they teach our students the white man is responsible for all of the worlds Ills? we will not win this war as Gen, Patton and Gen, MacArthur said after WW11 "America will never win another war" they knew something we didn't know at the time, "NO ONE CAN WIN a P.C. WAR, it has never been done nor never will, so when you bleeding hearts cry over the enemy just remember , WILL YOU CRY FOR THEM WHEN THEY ARE KILLING YOUR SON'S RAPING YOUR DAUGHTERS , WIVES, MOTHERS, GRAND MA'S? I would bet some of you would be like the guy who was trying to reason with a rapist ,while he was raping his daughter,

the military has their own justice system and rules.
the higher up you are the more respect you get and better representation, i believe tha if this case had not gotten out to the public he would not have been disciplined.
the military is supposed to hold peaple to a higher standard, raise the bar!

if it would have been just a drunken barroom brawl or a minor infraction of the rules a few days in the brig!!!

they take care of their own!!

but for a heavy duty case that is meade public the man didnt have a chance!!!

I believe they go to Levanworth(Sp?) just for the military I think. As far as the marine you're talking about, I think that if you commit the crime, you do the time, no matter who you are, or what you do. I PROUDLY support our military...my husband is a vet...but they are human too, and they should get the same punishment. But that's just my opinion!

if the 2 people in the same position commited the 2 crimes, they'd get the same sentence. murder is murder no matter where it was done, and a low life murderer is not better than a low life rapist.

They shouldnt go to prison for doing their job. Only traitors should be hung.
