5 Witnesses? Take him to court, you can't lose. He will have to pay damages and your costs too; that should stop his behaviour.

I'm sorry for you loss but give that poor women a break. Yes your unwell so you asked to be alone which you were... It's boxing day, they missed christmas with you so of course they want to spend time with you, and for all you know your daughter-in-law could genuinely be worried about you. You're blaming her for the eldest for making noise, surely thats his fault, he should know not to be loud if you were feeling unwell, next time just ask him politely to tone it down a little. Asking you if you're eating properly.. What's wrong with that? I'm sorry but someone is asking you if everything is ok, and you are looking at it wrong, she might not be the type to easily bond and connect with you and this is her way of checking if you are ok. If she judges you for drinking every now and then, ignore her, you said it yourself she drinks so just know that she's contradicting herself. You're upset which is the norm! But maybe you are reading into things a bit to much. If you don't feel up to babysitting say that you can't because you are unwell, she can't force you. But she didn't ask you so at least she took it into consideration that you were un well. And lastly.. Monsters Inc.. I'm sure the kids will surivive it's not that bad don't worry. EDIT well she can probably guess that if she had rang you would have told her to go away, when she's upset or ill she may like having people around her and thought thats what you really need, and that because it's christmas you shouldn't be alone, and should have family around you. Don't assume things, you don't know what she is thinking.

Even though he braked hard first, it is still your fault as you should have been a fair distance behind him, if as you say it was in a standstill you shouldnt have been going to fast otherwise you wouldnt have hit him. Perhaps your attention was diverted. However you only hit the rear bumper of the car andd therefore it is not your responsibility to pay for his bonnet to be resprayed. Take him to court on the grounds of blackmail and depression. It is not your responsilbility to pay for his bonnet especially as you payed for the respray.
You have a 90% chance of winning the case. Threating him with it and see what he says

Get the insurance company to deal with it - that's what they're there for.
Never admit any fault. You'll have to get your passengers to state that you gave him money and send those statements to your insurers. You might be lucky enough to avoid the phoney whiplash claim if it's three weeks later and he hasn't mentioned an injury.
Tell him to contact your insurers and then ignore any more dealings with him directly. There's no getting away from the fact that you were driving too close to the guy in the first place. If you hit the back of him - It's your fault. He knows this and is trying to blackmail you because of it.

I would report him to the police. That may have been the reason that he stopped short, just so that you would hit him. Sometimes it is done to get money from the insurance company. You should also report it to the insurance company, they will know if they have paid the guy off before for the same type of accident.
Sorry it happened to you, but there are some dishonest people out there. good luck.

i am a disabled driver and this type of driving is becoming more and more common in this country, what is happening is that crooks are choosing there targets and then pulling in front of you and then braking suddenly causing you to rear end shunt and then claim for everything they can e.g.whiplash etc etc, this warning has been given to all disabled drivers that get the lifestyle magazine.you have made a mistake by paying for the damage, you should have insisted it goes through the insurance company and if any doubt involved the police, although they may not get involved unless of injury.

Tell them to piss off! and call your insurance company. And never phone again. Your not restoring that car only repairing the damage. It is up to him to pay for any extra respray. And you are not going to provide any more money for rent car or extra work.

Got to the police and make a statement. Ask them for advice on this matter. Tell your blackmailer that you've been to the police.

O.K. crybaby, enough about your problems....no one needs to ask the same question three times. If the jerk is threating to go to his insurance company then LET HIM! What's the big deal? Do you honestly think it will be worse than what you're facing NOW??
Damn....
