Sections 279 and 338 under the Indian Penal Code? Please provide some details regarding how long traffic accident cases take to be resolved in courts or can it be settled mutually, between the victim and the offender, in courts.

Indian Penal Code section279 provides: Rash driving or riding on a public way : Whoever drives any
vehicle, or rides, on any public way in a manner so rash or negligent
as to endanger human life, or to be likely to cause hurt or injury to
any other person, shall be punished with imprisonment of either
description for a term which may extend to six months, or with fine
which may extend to one thousand rupees, or with both.
Section 338 provides: Causing grievous hurt by act endangering life or personal
safety of others : Whoever causes grievous hurt to any person by doing
any act so rashly or negligently as to endanger human life, or the
personal safety of others, shall be punished with imprisonment of
either description for a term which may extend to two years, or with
fine which may extend to one thousand rupees, or with both.
As far section 338 is concerned the offence is compoundable under section 320 of the Code of criminal procedure,1973 i.e. the person hurt can compromise it in the court. As far section 279 is concerned it is not a compoundable offence & for which one has to face punishment which usually is in the form of fine & very rarely any imprisonment given in such cases. The time this case takes can be any thing from one to two years time depending on the time taken for getting all witnesses examination, so best course to deal for such cases is to go in for compromise with the party hurt in such accident case & request the court to dispose of the matter accordingly as you are prepared for compensating the victim & pay the fine that the court decide in such cases. Just pay the amount through bank draft that you agreed to the victim before the court & the judge will order you to pay some amount as fine under section 279 that you have to deposit in the court treasury & you are free. I have personally handled many such cases.

By the IPC- its may be three years ... but this is a bailable offence and i think there is a fine condition also .....
