I quit my job due to a family emergency and i didn't call her and inform her until a week later since i think my family was more important and she wont give me my check she held for a week and 2 days i worked. she also doesn't do taxes she pays under the table for her business, couldnt i hand her into some bureau for her not doing her taxes and not paying me?

i called her and she told me she would report me for tax evasion, so i said well ill get you for not doing and reporting your taxes into the better business bureau and she hung up on me, and havent called back so i went online and filed a complaint under the BBB so what will happen now?

If she does not send you a 1099, there is no way you can pay your own taxes. If you do get her on the phone, just say unless you get your pay , you will file a complain with the Labor Board and then tell her to have a nice day and hang up. I wouldn't pay anything in writing.

Sure you could turn her in, but by taking payments under the table you were also breaking the law and will have to pay taxes on all the money you have made up to now and maybe even some penalties.
I'd call this a life lesson, unless you are willing to lose more than that pay check. The IRS doesn't care who breaks the law, they prosecute everyone equally.
Of Course your family is more important, but a phone call doesn't take long and the courtesy probably would have saved you this problem

Call the Better Business Beaureo (SP?)
I have had this happen to me, and they were hindu owners of a restruant off the interstate, and they claimed that I didn't have a paycheck, I worked for free food for 2 weeks... hahaha That was a joke.
But I called the BBB, and as you said these folks did EVERYTHING under the table, plus more. So they got shut down, I never got my money though... But their building doesn't even exsist any more either, and I know the guy owner atleast went to jail, on top of looseing their business and getting fined.
That's the best advice I can give you.

Contact the Department of Labor in your state. I'm sure they will have something to say. That's the three words most employers are most afraid of, too by the way.
If it is money you earned, an employer cannot hold it from you, no matter how upset about your leaving they might be.
It may not be necessary to bother with the taxes thing, unless you really feel the need to. The Department of Labor may send someone in after that on their own. (After they've been looking up her sphincter with a microscope....)
Just be forewarned; if she's been paying you off the books, you may end up being liable for any taxes on the money she paid you.

By law an employer must give you a final check, if you are terminated with-in 72 hours, if voluntary with-in the next pay cycle, if they still with hold it you can file a complaint with you local Labor Board Agency.
They can be help up to 3x times the amount of your check if they refuse to pay you.
Well under the table is going to be hard, the problem your going to have is proof of your work, and your salary agreement, you might have to take her to small claims court.

She is required to pay you for the time you worked, whether or not you quit without notice. You could sue her in small claims court, or call your state department of labor.
As far as her paying under the table, you could report her to the IRS. Of course, if you have been taking the money and not reporting it and paying the proper taxes, you are in trouble right along with her.

That is illegal for her to hold your check. Call the Workforce Commission in your area. Look in the phone book under the goverment section.

You can absolutely report her - you're not getting any social security credit or unemployment credit either. Threaten her with reporting her and report her even if she gives you the check

Report her to IRS and Wage and hours. Tell them that she withheld your money b/c she is paying under the table. They will freeze her account...she will be in deep shi.t
