Any answer which is "yes" or "no" is absolutely WRONG.

(1) Jurisdiction. This refers to the federal, state and/or local laws that apply to and govern this question. Where did the employee work? Some jurisdictions have liberal laws that give an employee and ex-employee broad rights to obtain copies of applicable employment records without court process; other jurisdictions do not. Without knowing the precise jurisdiction, an accurate answer cannot be given.

(2) Employer. Many employers have rules and policies which govern this question. For example, government employers (the federal government, state governments, etc.), public corporations, non-profits and charitable companies, and many other companies have specific rules about such records. Without knowing at least the type of employer, an accurate answer cannot be given.

(3) Employee Status. An employee's own status may govern the question. For example, if the employee is a member of a union or has an employment contract, then the contract may govern this question. Without knowing the employee's status, an accurate answer cannot be given.

Yes, you are entitled to a copy of any performance reviews, salary actions, etc. that are in your file - you may be required to pay a nominal copying fee.

If you're involved in a lawsuit your attorney can also subpoena all records on your behalf - medical records, payroll, etc.
