my ex and i got into a huge fight last nite. he sent me a text sayin he was going to kick my ***, hurt me and he even said he would kill me. he even asked me how did i want him to kill me? this is not the first time he said he would do harm to me. awhile back he said he would hit me with his car. he has never laid a finger on me. i'm just wondering is he all talk or should i get a restraining order against him. i still have all the texts he sent me. what would you do?

Go to the Police show them the text message and then got to the court house and get a restraining order! Too many people don't do anything until it is too late, GO NOW!

Never take a death threat lightly from anyone. Remeber, even though he's never laid a finger on you doens't mean that he won't in the future. If the relationship isn't working out, just break it off because being in a relationship shouldn't be about being miserable all the time (Don't make excuses for him because he's an adult and knows what he's doing).

As for the restraining order, I would call the police for further advice. You can get a restraining order but you would have to go to court.

First, you need to consider your next steps carefully. If he shows up to actually harm you, a piece of paper will do nothing to stop him.

When you do go file for a protective order, and the police/judge sees your evidence, they will probably want the DA to press charges, and then your ex will be in serious trouble. From the sounds of it, he deserves it. Once this process is started, it's out of your control. If he sends you flowers and you want to make up with him, tough luck, because it's no longer up to you.

If he makes the threats, he just might one day make good on them, regardless of never having laid a finger on you. As long as it's 100% true, and he made threats, that's considered domestic violence and/or menacing.

While you do this, I would suggest living in another place, changing your schedule, etc. and buying some personal protection, be it pepper spray, whatever.

If I were you I would get a restraining order and stay away from him. If he really cared about you he would never threaten you in any way. It sounds to me like he needs counceling. He might just wind up doing some of the crazy stuff he is telling you he is going to do.. BE CAREFUL..... I have already been through a relationship like the one you were in. :] Take Care

You can apply for a restraining order -- the court will determine if the threats are credible enough to issue one.

Just to be on the safe side...get a restraining order. If he is to threaten you like that, then I believe that someday he may carry out on his words. Please, keep yourself safe!
