When a baby is born to an un-wed/single mother, who's last name to they receive. I've seen babies with the mother's last name and some with the father's.

Who makes the decision the mother or the father?

Well, if I were doing this on my own, the baby would have my last name. It is really up to the mother!

I would say that the baby should have the mother's last name if the father is not going to stick around. I mean why would you give the baby the last name of someone who's not going to stay in the child's life? I think it's ultimately up to the mother and dependent on the situation.

The mother makes that decision. Since the parents are not married the father usually has to be proven the father before he has the legal right to make any decisions for the child. Also most states let you give the baby the father's name without his permission but they don't let you put the father's name on the birth certificate without his permission. And ladies who want to be in control, remember that if he doesn't have rights he generally doesn't have responsibilities either.

This is the first of probably many decisions single Mom's make. There really is no rule of thumb as there are pros and cons with both options. But the final say goes to the Mom, though the father may petition the court for a name change later if paternity has been legally established and child support is being sought.

That is a Good question....
there are many scenarios to the situation...if the fathers not involved or is involved the mom has a say.... if the mother doesn't know who the father is, it is up to the mother.....the mom can make up a name even....U would totally be surprised who's name a baby just might get!!
If this is confusing, it "really can be!"

The mother makes the decision ultimitaly....if the father IS present at the birth, usually the baby gets the father's name....if he is not there, then the baby gets the other's but you could ake up a last name....It's your kid! Whatever you put on the birth cirtificate

It's a private choice between the mother and father, ultimately being the mother's. Different laws in different states. In Arkansas you can give the child whatever name you desire as a last name.
You can give the baby the father's last name, but to have him listed as a father, he has to sign a paternity form.

If you are single and doing it on your own then it would be up to you. Its your decision. If you arent with the father then most people give the child the mothers last name.

The mother doesn't even have to say who the father is and is the one who makes the decision.

That really depends on you. If the father has been there throughout the pregnancy and plans to be involved in the baby's life and help support it, then you can go with his last name. Otherwise, you can go with your last name. It really just depends on what you and the father feel best. My instinct would be to stay with the mother's name.
