I am 16 years old I would like to live with my father, I just recently met him for the first time about a year ago. My mother and I are not close, she is a unfit mother and doesn't even put the child support my dad pays to me and my brothers needs. She spends it on ciggs/drugs/and clothes for herself and a kings island ticket for my sister(-half sister and my dads child support isn't toward her, her dad pays for her). I want to know if I have the right to choose which parent I want to live with. Now, my dad doesn't have custody but he pays child support and I feel If I have to put up with all this drama and stress my mom puts on me anymore I will jump out a window or run away. She is horrid, like the wicked step mom in the fairytales. Bleh. Me and my dad are really close already and from spending long periods of time at his house I understand him better then my mom and he will at least listen to me.

Yes you have a right to tell the judge where and with which parent you want to live, adn judges take that into serious consideration when making decisions. That doesn't mean he will do as you ask, but he/she will certainly listen.

Talk it over with your Dad, if he agrees, then it is time to get an attorney.

Yes u do have the right 2 choose where u want 2 live.....its usually a long process but if both ur parents agree on it then it should be pretty short....but yeah u r @ the age where u can choose where u live....but the laws r different 4 every state so u need 2 do some research

You just recently met your dad its easy to act like a great father when you havent been around for the most part. Dont get your hopes up and talk to him before you make any decisions is he even okay with the decision your thinking of making? Dont set yourself up for disapointment if your mom has those issues and it turns out your dad is not willing to accept your decision you can always try to get emancipated legally tell your dad your looking into this to see if he even offers you to stay with him. That way you dont have to go through a another denial that would hurt you.

Have you told your dad how you feel. If he agreed to that I am sure at 16 you could choose. But if that would be too much for him if he only met you a year ago you will feel terribly disappointed so just be prepared for that. It does'nt mean he does'nt love you so keep your good relationship with him.You seem really unhappy with your mum so I hope your Dad will have you and you can be happy. Best of luck xxxPam

Of course you have a choice. Kids at the age of 8 have a choice ( in arkansas anyways ) It would be best to have dad hire a lawyer but i had a case with my x to get the child out of state that i just wrote a letter to the clerks office and they made me a court date. I went in front of the judge and got what i wanted. I wish u the best of luck...

I have a friend of mine who has a similar situation to you. My friends child called Family Services in our state and through the family service department they were able to determine that His Dads house was the better fit for the child. Since you are 16 and your brother is seventeen they will probably just take your word for it and place you with your father. Good Luck!!
P.S. I just spoke to another friend who is a social worker and she said to do the same thing I just suggested and that is to call Family Services in the county in which you live!!!!

In Texas at 12 you have the right to decide who you live with, I don't know all states age limits. If you really want this it will have to be done legally, with an attorney. And sometimes it goes to court. Good Luck, I wish you the best!

I see you want to go but can your dad take you and your brothers because they may still need you to look out for them talk to your dad and then have him seek custody of all of you. This way you can stay a family a real family.

I've always heard that at the age of 13 you have the choice, but I know for a fact if you go to a judge and tell them what you said in your question, let them know what's going on... they should for sure let you live with your father.

A child can choose which parent they want to live with as young as 13 that I know of. have your father bring it before a judge and you can testify if needed
