im work a contract labor type job, and he changed my mileage, so i will get paid almost 500 less. its not fair, and i had to pay for my own gas, use my car, and put wear and tear on my car. so mad. what can i do in texas abt it?

Sorry, but he can pay whatever mileage rate he wants to pay you. The good thing is that by being a contract employee you can deduct the difference between what he's paying you for mileage and the standard irs mileage rate, which is 48.5 cents per mile for 2007, and was 44.5 cents per mile for 2006.

If you're doing contract labor, just bill him for the excess. If he refuses to pay, tell him to pound sand.

As a contract laborer you have no rights under state labor laws or the FLSA.

If you think that you may actually be an employee -- such as if your "boss" provides you the place and tools to work, sets your schedule, etc. -- then download a copy of Form SS-8 from the IRS website, fill it out and mail it to the IRS. They will make a determination of your status. If this goes in your favor it won't help with the mileage reimbursement any (an employer can require you to use your own vehicle without reimbursement) but at least your tax bill will drop and you'll be covered by the various labor laws and Worker's Comp. (And you'll probably make his life MISERABLE with the IRS!)

Try small claims court. Seems like he's the one who should be reimbursing you for your mileage. Not the other way around.
