My sister died in 2003 and left her 4 kids to our parents. My father died in 2006 which left the kids with my mother. My mother is irresponsible and is not taking care of them. My sister, my brother- in- law ( my deceased sister's bf) and myself are tring to take custody of my niece and nephew ( the other two are now grown) but we can't because my mother refuses to coperate.Everytime we talk to her its a different story. My mother is homeless and cannot care for them but refuses to even give us the docs we need to do so (birth certificates, ss card, insurance cards ect..). And the court system won't do anything unless we have my mother arrested. We can't go get the docs without proof of custody.. Does anyone have any ideas ????? What can we do. We are in FL and the kids are 12 and 15

I am confused a bit, you say the BIL(deceased sister's boyfriend), is he still in the picture somehow? If he is, what is his status as far as being the parent goes? Where is the biological father?

As far as the court system not doign anything, you need to get an attorney and sue her for custody, go to the hearing and present your case. If it as you say it is, then you should haev no problem gaining custody. At 15 the oldest should be able to give great input to the judge as to where he/she wants to live, if not make the sole decision himself?herself

Homeless? Where are the kids staying then? Family? Friends?

That alone is enough to get the state protective services involved.

First, talk this over with a lawyer, and then follow his/her advice.

Next, contact Child Protective Services and explain the situation to them.

If your mother being arrested is really what is needed to help these two children, you don't have much of a choice, do you? Your mother can stand up for herself, but the two kids have only you to help them.

Act. Choose.

Every child deserves a champion; be theirs.

well thats kind of hard. i would do whats best for the kinds.What i think is best for the kids is to let your mom get arrested and then gat cusody of the two kids.your mother will soon get out and the two kids will have a better futrue. make sher the kids go to school.

call your local social services. tell them your concerns and explain your willingness to help.
