If you can't get the employer to provide a W2, then your best bet is to prepare a substitue statement using Form 4852. here's a link: http://www.irs.gov/pub/irs-pdf/f4852.pdf
Base the information you report on your last paystub, bank records, back-cacluation, and whatever means you can to come up with as accurate numbers as possible.
In the event that after you file the substitute form, you recieve a W2, and the information is different you'll need to file an amended return for that year.

Ask the IRS to see what they have on file and they will give that info to you. If you're past employer did not issue W-2's then you need to discuss that with them as well. 1-800-829-1040

Call the IRS about why you can't get them. If a former emploiyer just hasn't bothered to provide you with one, then the IRS will contact them and light a fire under them to do what they're required to do.

Contact IRS. Tell them that your former employer will not give you your W2's. They will then take action.

Got a copy of last paystub? If so use that. If not, keep trying with employer for copy of W-2's.
